C, pg 20 & 21: I Churchill Gaines of Boone County Kentucky being sound in mind memory and understanding but calling to mind the uncertainty of Human life and being desirous to make some disposition of my Estate by will to this and for that purpose I make and constitute the following to be my last will and Testament. In the first place I wish to be buried after my decease in a decent manner and that all my just debts should be paid as soon as the nature of the case may admit. Secondly I do will and bequeath the whole of my estate real and personal or mixed to my beloved wife Polly Gaines & to my son Edwin Gaines as follows for my wife to have and keep the whole of it until my son Edwin arrives to the age of twenty one years, at which time it is my will that it be divided between my said wife and son giving to my said wife one third and my said son the other two thirds of it be it more or less and be it in whatever kind of property that may then belong to my Estate. Thirdly It is my will & desire that my executor hereafter named shall have the liberty & privilege of selling and conveying the whole of my real estate or any part of it as well as my negroes or any of them either at publick or private sale as they may think best then and there to put the money out at interest or purchase other land or negroes with it for the benefit of my estate as they in their judgement may think best being careful however to have all debts on my estate to be well secured; and to keep a particular account of all their sales loans purchases income and expenditures of every kind. Fourthly It is my wish that my son Edwin should be well Educated----well raised and that such sums of money out of my estate should be expended for those purposes as may be considered necessary & prudent by my executor and also that my beloved wife Should in like manner have a genteel and comfort- able support out of it during her life & then for my son Edwin to have all that is hereby given or willed to her. Fifth. I do hereby nominate constitute and appoint my beloved wife Polly Gaines & my Brother in law Paschal Rucker executors & Executrix of this my last will & Testament.
