Isham's Heirs Bourbon Circuit Court Sct. Jany Term 1823 In Chancery Ishams Heirs complts against Isham Deft. In this cause the court made an order and decree, that John L. Hickman and Aquilla Parker (or either of them) be appointed commissioners to settle her accounts xc as admntix of Jonathan Isham decd., and to make partition of Estate and Negroes amongst the Heirs if practicable, reserving to the deft her third xc. Your Commrs. met the parties on the 6th day of May Instant at the house of the Deft. and Elizabeth Oneal and Robert Miller her Trustee, and Henry S. Bethers and Henny his wife, all being of age and consenting that the said estate and its profits and income (Except the Negroes) were not more than a compensation to Deft for her disbursments, trouble and expence with the legatees, and your commrs. feeling satisfied that it is as little and perhaps less than they would allow, If the estate afforded other funds, that could be thus appropriated, Have closed the accts of said admix as even and fully administered to the present day without making a detaled acct. They then proceeded to the examinaton, valuation and partition of the slaves as follows towit; Linda..........about 48 years of age..........value $225.00 Moses........ " 20 " " " .......... " 135.00 $1740.00 The Deft who is Guardian to her two Infant sons, consenting and wishing for convenience of distribution, that for the present her third should not be particularly designated, nor partition made between her sons at present; but that her third and their proportons should all be lotted together, which was done accordingly, alloting Linda, Moses, & Peter to said three shares upon their paying to Henry S. Bethers and wife within a reasonable time say on or before the 25th day of December next sixty five dollars in Specia, and alloting to Robert E. Miller the Trustee of Charles Oneal & Elizabeth his wife, Rose and Joshua upon the payment to said Bethers & wife as aforesaid, fifteen dollars in Specia, and alloting to Henry S. Bethers & Henny his wife, Mariah and the sixty five dollars aforesaid from the first lotments, and fifteen dollars from the second lotment, Given under our hands as commissioners as aforesaid this 28th day of May 1823.
