Young vs. Alexander Marshall Bill filed Nov. 1805 Archives Center Public Records Division Kentucky Department for Libraries and Archives PO Box 537, Frankfort, Kentucky 40602 The deposition of Wm Hayden taken before me David Owen Junior a Justice of the Peace in and for the County of Gallatin in pursuance of a _______________ this 5 (1?) day of July 1805 to be read in Evidence in a Suit in Chancery now Depending in the Mason Circuit wherein Alexander H. Marshall is Complainant and Thomas Young Deft this deponant being of full age deposeth and saith That in the year 1776 he in company with Willis Lee, Henry Lee, Richard Lee, Joseph Linsey, Wm Linsey, John Williams, Bartholemy Fitzgarald, Samuel Boggs and others went from Leestown in the month of Feb to the place now called and known by the name of Mays Lick then called by the Company a Deer Lick. We Incampt there the first night. In the morning we divided our Company into three and two of the Companys took a different rout. The three Lees, my self and two Negros continued at the Lick and thereabout for seven days and made a number of Improvements in the Neighbourhood where ever we found an appearance of a spring on (one?) up the Lick Branch about three Hundred yards and that was the Nearest to the Lick one in Cornelious Drake's field and one at a Large Spring called Hayden's big spring where John Shotwell's State House now stands which Improvements were alloted to me by the company which spring and improvements was called for in Wm Mays Entry of Settlement and I shewed (?) them with the Springs to John Mcar (?)(might be John MC or), Thomas Young Commissioners and Miles ____ Conaway Surveyor at the time of perpetuating (?) Testimony of Wm Mays settlement. Question by Thomas Young: Did you look round the Lick for a Spring? Answer: I Looked Round with attention and found none nearer than where we made the Improvement in Drakes field as above. Question: At (?) what time the Deer Lick you speak of took the name of Mays Lick and by whom? Answer: I never heard it called by the name of Mays Lick till some time after the entrys of May was made. I do not know by whom the Lick was named. I think Mr May never was there till some time after the entry was made. Question: Was there a Spring called May Spring at the Lick or near it? Answer: There was not any Spring called Mays Spring at that time nor none nearly the Lick than the Spring above named in Drakes field to my knowledge. Question: Did you ever travel the Road that crosses the north fork near the mouth of Lees Creek called the war Road or Middle Trace or did you Know that Road? Answer: I did not know nor did I know it at that time. Question: Was you acquainted with the War Road that corsed the north fork at the mouth of Mill Creek or did you hear of it that led from Lime Stone to the Lower Blue Lick? Answer: I never traveled the Road but heard of it I think as early as the year of 1780. And further this deponant saith not.
