I Nicholas McIntire of Jefferson County in the state of Virginia being of sound mind and memory do make and ordain this my last will and Testament in manner and form following that is to say. I give and bequeath unto my two sons Isaac McIntire and Jacob McIntire all the use interest and income eaqually between my two said sons of the plantation and land where I now live on untill such time as the said land may be sold by my Executors hereafter mentioned and when the said land is sold for the full value thereof and it is my will that after the land is sold as above mentioned by my Executors that my son Isaac do receive from my Executors of the price of said land seven hundred dollars to him and his heirs forever. Item I give and bequeath to my son Jacob eight hundred dollars out of the price of said land also one negro boy named Bill and one sorrel stud horse and one feather bed and furniture to him and his heirs forever. Item I give and bequeath to my grandson William McIntire son of David McIntire Dec'd one hundred dollars to him and his heirs forever. Item I give and bequeath to my granddaughter Elizabeth Aguston daughter of David McIntire Dec'd fourteen dollars to her and her heirs forever. Item I give and bequeath to my granddaughter Abigail Welsh daughter of David McIntire Dec'd fourteen dollars to her and her heirs forever. Item I give and bequeath to my granddaughter Priscilla Hains daughter of David McIntire Dec'd fourteen dollars to her and her heirs forever. Item I give and bequeath to my granddaughter Lydia White daughter of David McIntire Dec'd fourteen dollars to her and her heirs forever. Item I give and bequeath to my grandson William McIntire son of William McIntire Dec'd ten dollars to him and his heirs forever. Item I give and bequeath to my grandson Joseph McIntire son of William McIntire Dec'd ten dollars to him and his heirs forever. Item I give and bequeath to my son Alexander McIntire one negro boy named Jourdon to him and his heirs forever. Item I give and bequeath to my son Joseph McIntire one negro boy named Elsar and also fifty dollars to him and his heirs forever. Item I give and bequeath to my son Moses McIntire ten dollars to him and his heirs forever. Item I give and bequeath to my (grand)son Nicholas McIntire son of Moses McIntire on negro girl named Rachel to him and his heirs forever. Item I give and bequeath to my son Thomas McIntire one dollar to him and his heirs forever. Item I give and bequeath to my daughter Elizabeth Linden one dollar to her and her heirs forever. I give and bequeath to my son James McIntire one hundred dollars to him and his heirs forever. Item I give and bequeath to my son John McIntire one hundred dollars to him and his heirs forever. Item I give and bequeath to my son Aaron McIntire one negro boy named Edward to him and his heirs forever Item I give and bequeath to Prudence Johns commonly called Prudence McIntire one negro woman named Rachael and also one negro gall named Tab and also one bay horse named Short and one womans saddle and bridle that is called hers to her and her heirs forever. Item It is my will and desire that if the said Prudence above mentioned should sue for any claim or claims out of my estate over and above what is willed to her in this instrument of writing then in that case it is my will and desire that what I have willed and gave to the said Prudence shall be null and void to all intents and purposes and said property shall revert back again to my estate Item It is my will and desire that after all my just debts and funeral expenses are paid that the remainder of my estate that is not heretofor willed shall be eaqually divided between my two sons Isaac McIntire and Jacob McIntire and to their heirs forever. And lastly I do hereby nominate constitute and appoint my son Aaron McIntire and my friend John Morrow Executors of this my last will and testament ratifying and confirming this to be my last will and testament In testimony whereof I have hereunto set my hand and affixed my seal this thirteenth day of March Anni Domo one thousand eight hundred and five Sealed and signed published and declared by the said Nicholas McIntire to be his last will and testament in the presence of Benjamin Forman James Verdin Nicholas McIntire (seal) William Morgan At a court held for Jefferson County the 11th day of June 1805 this last will and testament of Nicholas McIntire Dec'd was proved by the oaths of Benjamin Forman James Verdin and William Morgan witnesses thereto and ordered to be recorded and on the motion of Aaron McIntire one of the Executors therein named who made oath thereto according to law certificate is granted him for obtaining a probate that in due form giving security whereupon he together with James Verdin and James Glinn his securities entered into and acknowledged being in the penalty of twenty thousand dollars conditioned as the law directs By the Court Test. Geo. Hite C.J.C. Virginia Jefferson County to wit I, Geo. Hite Clerk of the County Court of Jefferson in the state of aforesaid do hereby certify that the foregoing is a true copy of the last will and testament of Nicholas McIntire Deceased now of record in my office. In Testimony whereof I have hereunto set my hand and affixed the publick seal of said County this 15th day of Oct 1810 and in the 35th year of this Commonwealth Geo. Hite (seal) I, John Keamley presiding Justice of the Peace in and for the said County of Jefferson do hereby certify that the foregoing attestation of George Hite Clerk of the Court of the said county is in due form of law.
