Cincinnati Post May 26, 1955
Police Chief Buster Stevens, Newtown, was acting within the scope of his 
official duties in a case which made him a defendant in a $10,128 false arrest 
suit.  So held a jury in Judge Ferd Bader's Common Pleas Court in finding in 
favor of Chief Stevens on a suit filed by Daniel W. Muhlberger, 28, 860 
Glenwood Ave, excavating contractor.

Muhlberger was a resident of Newtown October 20, 1953, when Chief Stevens 
ordered him to drive to the village building where he was cited to mayor's 
court on a charge of contributing to juvenile delinquency.  No such charge was 
formally filed against Muhlberger and a disorderly conduct charge against him 
on the same citation was dismissed without comint to trial.  It was not 
explained why there was no trial.

Chief Stevens, through Bernard J. Gilday Jr., attorney, showed that he ordered 
Muhlberger to the village building at 9:35p.m., or five minutes after the 
curfew on juveniles was passed when he observed several boys and two youths 
over 18 in Muhlberger's automobile
