BrieSkate@aol.com *********************************************************************** This mortgage made this 19th day of November 1889 whereas William C. Allgood and wife Miney Allgood of Breckinridge Co. Ky. being indebted to Layfayette Davis of same county and state in the sum of two hundred and twenty dollars evidenced by note of even date here of due twelve months after date. Now for the purpse of securing the payment of said sum of money together with all interests and costs which accrue thereon the undersigned mortgagor does hereby mortgage and convey unto said Layfaette Davis the following described real estate and personal property to wit my undivided interest in two tracts of land lying and being in the County of Breckinridge and State of Ky first tract lying partly in Custer and known as the Dr. Hall land. The second tract lies about one miles West of Custer and is known as the Bramlette tract of land. My said undivided interest in said tracts of land being 6/9 and was conveyed 5/9 to said Wm C Allgood by two deeds now of record in Breckinridge County Court Clerk's office in Deed Book No 40, page 373 and deed book No 41 page 445. Also on my crop of burley tobacco now hosed on my farm known as the Bramlett farm said crop consisting of about 1930 sticks. Said property is warranted free of encumberance and against any adverse claims. To have and to hold the said property to the said Layfaette Davis and his assigns forever; provided nevertheless that if the aforesaid Wm C. Allgood or his personal representative should pay to said Layfaette Davis the said sum of $220.00 when the same become due together with all interests and costs which may accrue thereon there this mortgage and such other writings as may exist as evidence of said debt shall be null and void. Otherwise to be and remain in full force and effect. And said granter hereby especially waive and release all right or claim which he has which arises out of or is given by the exemption laws of Kentucky. In and to the property here by conveyed and these covenants and conveyances are especially made a part of this mortgage. In testimony whereof I have here unto signed my name the day and year first about written.
