John Miller in this first one is Joseph's brother-in-law. Deed Book M, page 42-3: This Indenture made this 1st day of September 1838 Between John Miller & Judith his wife of the County of Breckinridge and State of Kentucky of the one Part and Joseph B. Ball of the County & state afsd of the other part; Witnesseth that the said John Miller & wife for and in con- sideration of the sum of one hundred & seventy dollars current money to them . . . paid . . . do confirm unto the said Joseph B. Ball, his heirs . . . . a tract . . . .lying in the County of Breckinridge on the waters of the East fork of the Beach Fork of Clover Creek containing two hundred fifty six and a half acres be the same more or less it being the same land that was deeded to J. Miller by George L. Ball [brother of the above Joseph B.] by deed dated the 27th Oct 1834 & bounded as follows viz: Beginning at a white oak corner to Claiborn Duval in a line of the original survey of Jno. Reed running thence N 75 E 37 poles to a red oak & white oak in Geo. Merrimittun line thence with the same S 35 E 104 poles to a large white oak his corner thence S 45 E 222 poles to a Dogwood & white oak thence S 65 W _? to white oak sugartree & dogwood corner to said Duval thence a long [said] Duvalls line North 15 west 322 poles to the beginning containing 256 1/2 acres--and all the estate rights, title and interest that the said John Miller had in etc. to [above] tract of land. With the appurtenances TO HAVE AND TO HOLD the said . . . Joseph B. Ball, his heirs . . . the said John Miller doth covenant . . . that he will warrent . . . to Joseph B. Ball, his heirs . . . claiming by, thro or under them but no farthur . . . IN TESTIMONY whereof they . . . John Miller & Judith, his wife have herein set their hands & seals, the date above written. The within Deed was this day duly acknowledged by the within named John Miller to be his act and deed and admitted to record . . . County Court Clerks office March 7th 1840. This Deed was produced to me in my office and signed, sealed and delivered. And I having examined the within named Judith Miller privily & apart from her husband she declared that she did freely and will- ingly seal and delivered said writing and wishes not to retract it. And acknowledged said writing again shown and explained to her to be her act and deed and consenteth that this certificate may be recorded whereupon the same is duly recorded with the Deed . . . Deed Book __, page 295: This Indenture made & entered into this 5th day of December 1848 Between Jefferson Jennings & Susan F. N. Jennings his wife of the first part and Joseph B. Ball of the second part all of the County of Breckinridge and state of Kentucky. Witnesseth That the party of the first part for and in con- sideration of the sum of Seventy five Dollars to them paid Have . . . sold . . . to J. B. Ball, his heirs . . . a tract . . . on the waters of Clover Creek & is bounded as follows viz: Beginning at two White oaks & Sassafras corner to Wm. Ander- sons 131 acres in a line of Wm. Hardin's 500 acres Thence with Hardin's line S 42 degrees E 127 poles to two White Oaks Hardins corner on James Douglasses line of his 2000 acres survey thence with Douglas line S 49 degrees West 128 poles to a White oak & Dogwood at the intersection of Douglas line with Wm. Buckners 1224 acre survey Thence with N. Buckners line N44 W 66 poles to a White oak and gum Buckners corner thence with another of Buckners lines S 44 W 62 poles to two dogwoods and Black oak at the inter- section of Taylors line of his 1000 acre survey Thence with Taylors line N 43 1/2 West 36 poles to two white oaks & dogwoods Taylors corner thence at 26 W 30 poles to two dogwoods & chestnut Andersons corner thence with his line N 48 East 173 poles to the Beginning containing 125 acres be the same more or less said land was patented to the said Jefferson Jennings by patent bearing date the 29 day of April 1847. With the appur- tenances to have and to hold the same to the said Ball, his heirs . . . forever and the said J. Jennings agrees to warrent & defend the title of said Land against the claims of himself, his heirs . . . In Testimony whereof the said Jefferson Jennings & Susan N. The only reference I have for book and page is Decedent Estate Book No. 7, page [cut off on my copy.] I don't know if all these records came from that book.
