The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. *********************************************************************** Will of Byron Bandy Know all men by these presents that I Byron Bandy being of sound mind and knowing the uncertainty of life do make this my last will and testament and by this do revoke any and all wills made previous to this and I trust one and all will realize that in doing this I have tried to do right by all. First, I bequeath all the household goods consisting of beds, bedding, chair, all goods in living part of house to my two beloved daughters Nancy Elizabeth and Letitia Jane to be divided equally between them. Second, I bequeath to Harriet Jordon(col) all my kitchen furniture, stove, cooking utensils & c. Third, I want all my livestock to go to my four sons, John, Dick, Will and Silas, together with all farming tools about the place these to be equally divided. Fourth, I want Harriet Jordon (col) to have one half the fowl around the place. Fifth, I want all my land consisting of 365 acres more or less to be sold to the highest bidder. I want the old home tract to be sold in 2 tracts, 100 acres off of the S.W. end to consist of 1 tract, 165 the other, the 96 acres or the other tract to be sold separately from the home tract. The proceeds to be divided equally between my six children after making the following bequeaths. Sixth, I want the other part (1/6th) belonging to Silas to go to his 8 children, 5 by his first wife and 3 by last wife, the amount going to the 5 children by first wife they to receive their portion in cash at the time farm is paid for, the 3 to receive their portion through their guardian or father Silas. Seventh, I want Harriet Jordon to receive $50 dollars in cash to be paid to R.S. bandy as guardian for her. Eighth, I want all my just debts paid and I appoint my son R.S. Bandy my executor to serve without bond. Ninth, If after my death and debts are paid there is any money left in bank or in my possession it is to be paid to Harriett Jordon (col) through her guardian R.S. Bandy.
