All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ky/kyfiles.html ************************************************ File contributed for use in USGenWeb Archives by: Mary Pool mimsi444@gmail.com June 29, 2013, 9:22 am Source: Breckinridge County Will Book, 1 Written: October 29, 1861 I, Elias Rhodes, of Breckinridge County State of Kentucky, Knowing the Certainty of Death and the Uncertainty of when that event shall happen I do make this my Last Will and Testament as follows 1st It is my will and desire that after payment of all my just debts and funeral expenses as follows to wit I give and bequeath to my beloved wife Margaret Rhodes the farm on which I now live together with all the farming utensils household and kitchen furniture and one half of all my stock on the farm at the time of my death and my negro girl Milly to have the use and enjoy the benefit of during her natural life. 2nd The farm on which I now live and farming utensils I give and bequath to my son Elias Rhodes subject to the above devise to his mother and should he continue to live with his mother until her death I devise to him all the stock that may be then on the farm and half of the household and kitchen furniture. I also devise to my son Elias Rhodes a negro boy named Jackson. 3rd I give to my son John Rhodes my negro boy Charles. I give to my son Elias Rhodes a negro girl named Mulvana. I give to my son Frank Rhodes a negro boy named Andrew. The above devise that is to say Elias Rhodes, John Rhodes and Frank Rhodes the three negroes given to them is to be valued by Min Chasen of the County Court and the said Elias Rhodes, John Rhodes and Frank Rhodes is to pay the balance of my heirs their equal part of the value of the said negroes. But the said John Rhodes, Elias Rhodes and Frank Rhodes seting them equal portion. And should there be any further increase in my negroe Fanley they are to be valued and evenly divided in the same way the negro girl given to my wife. At my wife's death is to be sold and the money equally divided among my heirs. Should I have any money and have at my death it is at the disposal of my wife to do as she pleases. My daughter, Elizabeth Henning, dec'd, I have given her children their portion in land. I appoint my sons John Rhodes and Frank Rhodes Executors of this my Last Will and Testament where of I have to set my hand and seal this 29th day of October 1861. Elias Rhodes Isaac Dehaven H. E.
