SUMMERS, Commissioner for and in behalf of CRAVEN PEYTON, BENJAMIN OSBORNE and EDWARD McDADE of the first part and GABRIEL COX of the County of Bullitt and State of Kentucky of the Second part. Witnesseth that Whereas by a Decree of this Circuit (the Bullitt Circuit) in the Suit in Chancery in the name of the said COX against said PEYTON, OSBURNE and McDADE and SAMUEL BROWN, WM. BURKHEAD, Jno. D. LUX and MATHIAS ROUSE the 27 May 1826 the said PEYTON OSBURN and MCDADE were by said decree directed to Convey to said COX one hundred and thirty acres of Land more or Less by deed with general warranty on or before the Circuit Term 1825 (or 1826?) and the said Defendants PEYTON OSBURNE and MCDADE having failed to Execute the Conveyance were directed afterwards towit on the 24 February 1827 at a Subsequent term of said Circuit Court NOAH C. SUMMERS was appointed Commissioner to Execute the Conveyance to said COX in the behalf of said PEYTON, OSBURN and McDADE for the land in said Decree. Now in Consideration of the premises and the power vested in me as Commissioner, I have granted and Conveyed to the said COX all the right title and Claim of them in the said One hundred and thirty acres of Land more or less being part of DAVID LEACHS 14,000 acre Survey and Bounded as follows viz Beginning at a stone corner to WILLIAM K. (?) BURKHEAD on DAVID LEACHS most northwardly line, thence with said BURKHEAD’s line South Sixty one degrees, East one hundred and ninety Seven poles to three white oaks, corner to BURKHEAD, thence north twenty nine degrees East one hundred and five poles and six tenths of a pole to an ash beech and dogwood thence North Sixty one degrees West one hundred and ninety seven poles to two Sugar trees and a white oak thence South twenty nine degrees West one hundred and five and six tenth poles with LEACHS old line to the Beginning.
