KY Deed Book L p. 33 Benjamin F. CALDWELL by Noah C. SUMMERS, Commissioner for him for that purpose on one part and William KURTZ of the second part. That whereas a suit in chancery depending in the Bullitt Circuit Court in the name of said KURTZ agst. CALDWELL - the said court did by its decree of the 14 Oct 1845 direct said CALDWELL to pay to said KURTZ certain sums of money as therein directed on or before the 1st day of April Term 1846 or on failure the Land in the bill mentioned and exhibit filed, should be sold to pay said Sums and on the 7th of April 1846 said Court made an order shewing said money, as decreed, was not paid and directed Comr. H. C. THOMAS to sell the land to raise the money decreed to be paid and said Commr. did on the 15 Jun 1846 sell the land for the sum of $200 and in October Term 1846 returned the report and sale to the Circuit Court and N. C. SUMMERS was appointed comr. on the part of CALDWELL to convey the land as sold to said KURTZ... the said land being a part of tract of some 130 to 150 acres of land on the waters of Long Lick Creek, Bullitt County being the same tract of land that B. HALOWELL lived 10 Oct 1840 and the same tract first shared by said CALDWELL at Sheriffs sale as the property of William KING reference to the deed to said B. F. CALDWELL of record Bullitt County Court and the deed of mortgage from said CALDWELL to KURTZ filed in Chancery suit herein referred to date 10 October 1840 and recorded Bullitt Co.
