EVANS and Elizabeth his wife formerly Elizabeth HALL of Jefferson County and City of Louisville, Cornelius BOGARD and Catherine his wife of Bullitt County all of the state of Kentucky of the first part, and John HALL of Bullitt County and state aforesaid of the second part, Witnesseth: That whereas Simeon HALL decd by his last will and testament made and published before his death which is of record in the clerks office of the Bullitt County gave unto his wife now his widow Nancy HALL the use and benefit of all the lands of which he deed(?) kized(?) and possessed of and whereas the said Simeon HALL decd possessed a certain tract or tracts of land lying in Bullitt County on the North side of Salt River and within the following described bounds binding on Salt River above and below the mouth of McCullocks run, in the South by the land of Zedkieh HARRIS in the east and with the line of James(?) NEWKIRK and Asa and Charles NEWKIRK on the north and in the line of David SLIGER and Wm GRANT on the west, supposed to contain 100 acres to the same more or less, and after the death of his wife Nancy HALL the land was to pass to his first daughter, towit: Polly OWENS formerly HALL, Elizabeth EVANS, formerly HALL, Sally HALL, Nancy HALL Jr., and Patsy HALL and whereas Sally HALL one of the legalus(?) departed this life intestate and without bodily issue, leaving here mother Nancy HALL, Felix OWENS and Polly his wife, John C. EVANS and Elizabeth his wife, John HALL, Nancy HALL Jr. and Patsy HALL her lawful heirs and representation (?) the title of Simeon HALL decd to the above described tract or tracts of land consists of a bond from Cornelius BOGARD and wife to Simeon HALL for fifty three acres of land more or less dated the 13th day of August 1814. of James NEWKIRK bond to Simeon HALL dated 17th of January 1813 a bond given by John TOOL(?) to William LAVELY(?) dated the 7th of February 1807 and was assigned by William LAVELY(?) to Cornelius BOGARD on the 14 of March 1808 and by Cornelius BOGARD to Simeon HALL on the 14 of December 1812 which several bonds are filed in the clerks office of the Bullitt Circuit Court in the name of David WILSONS heirs petition for the sale of land decree No 167 and whereas the said Nancy HALL widow as afsd has for and in consideration of the sum of Fifty dollars to her in hand paid the receipt whereof is hereby acknowledged hath bargained and sold and by these presents, doth grant, bargain, sell, release, convey and confirm unto John HALL and his heirs forever all the right title and interest that she has in and to the above described tract or tracts of land derived through and by the will of her dect husband Simeon HALL, also all the right title and intent which she the said Nancy HALL inherited by and from the death of her decest(?) daughter Sally HALL and the said Nancy HALL covenants and agrees to and with the said John HALL and heirs that she will forever warrant and defend the title of the usual(?) interests hereby sold from her ____(?) her _____(?) and from the claims of all person claiming on through or by her unto the said John HALL and his heirs forever and the said Felix OWENS and Polly his wife for and in consideration of the sum of one hundred dollars to them in hand paid by the said John HALL the receipt whereof is hereby acknowledged have bargained and sold, and by these presents doth grant, bargain, sell, release, convey and confirm unto John HALL and his heirs forever all the right title interest and claim that they have on and to the above described tract or tracts of land being the one undivided fifth part of the whole which they take by _____(?) of the last will of Simeon HALL dect, also the one undivided fifth of Sally HALL's interest in said land which they inherit as one of the heirs of Sally HALL dect, and the said Felix OWENS and Polly his wife covenant and agrees to and with the said John HALL that they will and their heirs shall forever warrant and defend the title of the undivided fifth of land hereby sold from themselves their heirs and from the claims of all person claiming on through or by them unto the said John HALL and his heirs forever and the said John C EVANS and Elizabeth his wife hath for and in considertion of the sum of one hundred dollars, to them in hand paid by the said John HALL have bargained and sold and by these presents doth grant, bargain and sell unto John HALL and his heirs forever, all their right title and interest that they have in and to the above described land or tracts of land it being the one undivided fifth of the whole land, which they derive title to through and by the will of their deceased ancestor Simeon HALL also the one undivided fifth of Sally HALLs interest in said land which they inherit as one of the heirs of Sally HALL, and the said John C. EVANS and Elizabeth his wife convenants and agrees to and with the said John HALL and his heirs forever that they will and their heirs shall forever warrant and defend the title of the undivided fifth of land hereby sold from themselves theirs heirs and from the claim of all person claiming on through or by them unto the said John HALL and his heirs forever, and whereas Cornelius BOGARD and Catharine his wife sold to Simeon HALL fifty three acres of land, be the same more or less in Bullitt County and gave their bond for the conveyance of the same bearing date the 13th day of August 1814 which bond is filed in the above suite of David WILSONs heirs petition for the sale of land in decree No 167 it being the tract of land that Cornelius BOGARD purchased of Richard JOHNSON which deed bears date the 3rd of Sept 1805 and is recorded in the clerks office of the Bullitt County Court in Deed book B page 62. which is referred to as for bounds and metes and whereas John HALL has purchased out the entire interest of the heirs of Simeon HALL in and to the said fifty three acres of land and is the sole owner of the same. Now therefore these present witnesseth: That for and in consideration of the bond executed by BOGARD and wife to Simeon HALL, and for the further consideration of the purchase money mentioned in said bond by paid by Simeon HALL to said BOGARD and wife, the said Cornelious BOGARD and Catharine his wife covenants and agrees to and with the said John HALL and his heirs forever that they will and their heirs shall forever warrant and defend the title of the above described fifty three acres of land more or less from themselves their heirs and from all person claiming on through or by them and from the claims of H. CRIST and WOODFORK(?) and their heirs and assigns unto the said John HALL and his heirs forever. In Testimony whereof the above named parties have hereunto set their hands and affixed their seals. F. SUMMERS(?) clerk of the County Court for said County do hereby certify that this deed from Nancy HALL and others to John HALL Jr. was produced to me in my county on the 15th day of July 1843 and acknowledged by Nancy HALL Cornelius BOGARD and Felix OWENS to be their act and deeds Polly OWEN wife of Felix OWEN and Catharine BOGARD wife of Cornelius BOGARD being examined by one privitly and apart from their said husbands declared that they did freely and willingly seal and deliver the said writing and wished not to retract it, and acknowledged the said writing and again shown and explained to them to be their act and deed, and consented that the same might be recorded. EVANS and Elizabeth P. his wife, parties thereto, to be their act and deed, that I examined the said Elizabeth P. privitly and apart from her husband, and having shown and explained said deed to her, she declared that she had signed, sealed, delivered and acknowledged it of her own free will and consent, without the persuasion threats or compulsion of her said husband, that she was willing it should be recorded, and did not wish to rectract the said acknowledgements and ordered to be certified, which is hereby done.
