HOLSCLAW and Letty his wife, all except said Upton TROUTMAN the heirs and representatives of John MIDDLETON dec'd, by N. G. SUMMERS, Commissioner for them for that purpose of one part and Benjamin NEWTON of the 2nd part. That whereas a suit in chancery pending in the Bullitt County Circuit Court in the name of Benj. NEWTON against said John MIDDLETON's heirs and the said Court did by its decree in said case 3 April 1849 decree and order that said defendants do on or before of October Term 1849 Convey the tract of land in bill and exhibit mentioned to Complet by general warranty deed that N. C. SUMMERS a Commissioner for that purpose should convey the same for them and the said Complainant NEWTON....wherefore in consideration of the promises, the piece of said land conveyed and confirmed to said Benjamin NEWTON .land lying on Lick (?) Creek with the appurtenances to the said tract of land belonging ... to Benjamin NEWTON and to his heirs and assigns forever against the claims of all persons whatsoevery.. and Said Upton TROUTMAN warrants the Said Land...
