Deed Book B p. 192 JAMES MATTINGLY and MARY his Wife of the County of Bullitt and Commonwealth of Kentucky to THOMAS BUSKIRK of the County of Shelby and Commonwealth aforesaid... for and in consideration of the sum of four hundred and sixty four Dollars twelve and a half Cents Current money of the United States of America to them in hand paid have given, granted, bargained and sold a certain tract or parcel of Land situate lying and being in the County of Shelby on the waters of Guesses Creek a branch of Brashear's Creek and Bounded by Mrs. PURDIES three thousand acre tract ... containing three hundred Acres and conveyed by BENJAMIN POPE and others to the said MATTINGLY ... Provided Nevertheless and these presents made upon this condition that if the said JAMES MATTINGLY shall pay unto the said THOMAS BUSKIRK his heirs and assigns the sum of four hundred and sixty four dollars twelve and a half cents on the twenty first day of January 1809 according to a bill executed on the day of the date hereof by the said MATTINGLY to the said BUSKIRK then this Indenture shall be void. And upon the same condition the said James MATTINGLY bargains sells and conveys unto the said THOMAS BUSKIRK his negro man slave FRANK purchased by him of WILLIAM CAMPBELL. And the said MATTINGLY covenants with the said BUSKIRK to warrant the said negro slave to the said BUSKIRK against all persons whatsoevery, But upon the express condition that if the said MATTINGLY shall make payment of the said four hundred and sixty four Dollars twelve and a half cents accordingly to the aforesaid Bill, then this Instrument and every thing herein shall be void.
