The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net Transcribed by: donkmill@aol.com Date: 22 Oct 2000 *********************************************************************** Deed Book K pages 468,469 This Indenture made this 23rd of September 1845 between Peter MILLER Sen. and Elizabeth his wife and John MILLER Jr. and Elizabeth his wife of Bullitt County State of Kentucky of one part and Henry MEYERS of the same place of the second part Witnesseth that the said party of the first part for and in consideration of the following sums paid and to be paid viz One hundred and ten Dollars Cash paid to said John MILLER and $50 to be paid him or his assigns the 1st of October 1846 and $30 payable to same 1 Oct 1847 and the sum of $50 payable to said Peter MILLER Sen 1 Oct 1846 and $30 payable to same 1 Oct 1847 and $50 payable 1 Oct 1848 and $45 payable 1 Oct 1849. Notes are given for same, this is the full Consideration paid & to be paid by said Henry MYERS to said P. MILLER Sen and John Jr for the land hereafter named. They the said Peter MILLER Sen and wife and John MILLER and wife Have Sold & Conveyed and by these presents do sell convey and Confirm unto him the said Henry MYERS and to his heirs and assigns forever the following tract of land lying on Knob Creek in Bullitt County being the same Land heretofore sold and conveyed by Martin HARSHFIELD Jr to said Peter MILLER Sen see deed of record in Bullitt County Court office and being the whole of said tract except those parts heretofore sold by said Peter MILLER Sen to Jacob DOOLIN of say about 52 acres and to George MONROE acres by boundary laid off to him and of acres to Isaiah DICKINSON now owned by John HARSHFIELD The balance of said tract here sold has been sold by said Peter MILLER Sr and wife to his son John and a support was guaranteed to said MILLER and wife out of said land and said Peter MILLER Sr. and wife and John MILLER and wife have agreed to sell said land herein named to said MYERS and thereby release the lifetime claim on the land for support and accept the Payment herein secured to be made to them in lien of any such claim And a lien is hereby retained on the land for the Payment of the various sums herein named. The land here sold is bounded by the lands of M. HARSHFIELD, DOOLIN. J HARSHFIELD and contains about 150 acres more or less Beginning at Abraham BEGHTOL'S line on Knob Creek and run down the creek with Martin HARSHFIELD'S lines round to J. Doolins line and with his lines to John HARSHFIELDS line and with his lines to MONROE'S lines and with his line to H(?) BECKTOLS line and with his lines to Abraham BEGHTOL'S line and thence with his line to the Beginning with its appurtenances To Have and To Hold the land and Appurtenances here conveyed to the said Henry MYERS and to his heirs and assigns forever And they the said Peter MILLER Sen and wife and John MILLER and wife do hereby covenant and agree to and with the said Herny MYERS that they will and their Heirs shall forever warrant and defend the land and appurtenances here sold unto him the said Henry MYERS and to his heirs and assigns forever against the claims of all persons whatever by this deed in fee simple with general warranty - Witness the hands and seals of the Parties this date first herein Written his mark Peter X MILLER (seal) John MILLER (seal) Elizabeth X MILLER (seal) her mark Elizabeth X MILLER (seal) her mark State of Kentucky Bullitt County I Noah C. SUMMERS clerk of the County Court for said County do certify that this deed from Peter MILLER Sen and wife John MILLER Jr and Elizabeth his wife to Henry MYERS was produced to me in my office on the 23rd day of September 1845 and acknowledged by the said Peter MILLER Senior and John MILLER Jr to be their act and deed. And the said Elizabeth MILLER being Examined by me privily and apart from her husband declared that she did freely and willingly seal and deliver said deed and wishes not to retract it and acknowledged the said deed again shown and explained to her to be her act and deed and consented that the same may be recorded. whereupon the said deed together with the foregoing Certificate thereon endorsed hath been duly admitted to record in my office Given under my hand this 8 day of January 1845 N.C. summers Clk **************************************************************** Deed book K pages 62,63 Whereas on the 27th December 1834 Peter MILLER Sen. executed a deed of conveyance to Jacob MILLER Jr. for a tract of land supposed to contain 254 1/4 acres bounded as set forth in said deed and with the reservations therein named which deed is recorded in deed book H page 132 Bullitt County Court office ; and said Jacob MILLER,Jr. on this same day made and entered his bond to said Peter MILLER Jr. to give him said Peter MILLER and his said Peter's wife a support during their lives as is espoused in said agreement of the said date recorded in said office in book H page 134 a reference thereto will shew and said Jacob MILLER Jr. was by the terms of said agreement bound to convey to his brother John MILLER the one undivided half of said trust of 254 1/4 acres of land on his John's coming of age, upon condition that the said John MILLER should on receiving said deed execute to his said father Peter MILLER his bond to assist in supporting the said Peter MILLER Jr. and his wife during their lives and since that time said Jacob MILLER Jr. has conveyed his undivided half of said land to Martin McMULLEN, and said McMULLEN has with the assent of said Peter given his bond to said Peter to support the said Peter and wife as said Jacob MILLER was to do - and now in consideration of the whole promises said Jacob MILLER Jr. and Louisa his wife do by these presents sell and convey hereby unto the said John MILLER the undivided half of said land: To have and to Hold the same and its appurtinances unto him the said John MILLER and to his heirs and assigns forever against the claims of them the said Jacob MILLER Jr. and wife and all others as fully as they are seized of the same - but in case the said tract of 254 1/4 acres of land bounded and described as set forth in said deed to said Jacob MILLER Jr., or any part thereof is lost to said John MILLER by reason of any other or better title or for any cause whatever then the said J. MILLER Jr is not to be held responsible to said John for the same: and said John MILLER in his part hereby agrees to and with the said Peter MILLER Jr. and covenants to and with the said Peter MILLER Jr. that he the said John MILLER will and shall feed provide and allow to him the said Peter MILLER Jr. and the wife of the said Peter MILLER Jr his aid & means to their support and maintenance during their lives agreeably to the true intent and meaning of the said several deeds and bonds and agreements herein referred to for that purpose: and particularly agreeable to the bond of said Jacob MILLER to said Peter MILLER of the 27 December 1834 of record as aforesaid - and this support hereby agreed, by said John MILLER to be by him applied and allowed to said Peter MILLER & wife forms the true consideration of this deed - and the consideration of this bond from John to Jacob MILLER is the land herein conveyed as specified and bounded in said recorded deed from said Peter to said Jacob MILLER Jr and the said parties hereby agree to abide and perform the true conditions of this deed and agreement and for that purpose said John MILLER binds himself to the said Peter MILLER Jr. in the penalty of Five hundred dollars. Witness the hands and seals of the parties hereto this seventeenth day of March one Thousand Eight hundred and forty three - test N.C.
