Deed Book K p. 345 Whereas by the last will and Testament of JOHN PURCELL dec’d amongst other things it was directed that I should maintain my Aunt THEODOSIA PURCELL during life and pay to her annually the sum of Seventy five dollars in Money and by the further directions of said will. I was directed to give Security for the faitful performance of said will, or secure her in her maintenance and the payment of said sum of Security five dollars annually by a mortgage on three slaves namely GEORGE, CHARLES and SOPHIA to the said THEODOSIA PURCELL and the said THEODOCIA PURCELL desires me to execute to her a mortgage on said Slaves to Secure her as afs’d More of or and in consideration of the premises, herein before recited and the payment of the sum of one dollar to me in hand paid I have this day pledged to her the said PURCELL the said three mentioned Slaves towit: GEORGE, CHARLES and SOPHIA as an indemnity to her in case I fail to comply with and discharge truly and faithfully the requisitions of said Will touching the before recited duty towards the said PURCELL and for that purpose the said Slaves are declared to be in pledge as aforesaid and I do hereby further agree, that if at any time I should fail to furnish or support or refuse to pay annually the said sum of Seventy five dollars that then and in that case the said THEODOSIA may and shall have the right forthwith to file a Bill for the foreclosure of this mortgage and have the said slaves sold for her benefit. But until default on my part I am to retain the possession of the said Slaves GEORGE, CHARLES and SOPHIA and use them as my own property.
