HARRISON, Samuel MAXWELL & Margery his wife late Margery HARRISON, Samuel RANKIN & Hannah his wife, late Hannah HARRISON, Adam RANKIN & Sally his wife late Sally HARRISON, William PATTON & Anna his wife late Anna HARRISON, children of said Anna HARRISON decd, Thomas COFER & Hetty his wife late Hetty GAY, Benjamin P. GAY, John GAY & James GAY, Jr, children of Sally GAY late Sally PATTON, Hugh ANDERSON, John PERRY & Benjamin PATTON acting Executors of Roger PATTON decd, Matthew PATTON, Samuel F. PATTON & Hetty his wife, Peggy PATTON, Sally PATTON, Anna PATTON & Polly PATTON children & heirs of John PATTON decd & James MILLER & Rebecca his wife late Rebecca PAT TON daughter of William PATTON decd who are the heirs & legal representatives of Matthew PATTON Senr decd of the one part & Thomas SPEED of Nelson County of the other part. Witnesseth that whereas by a decree of the Bullitt Circuit Court pronounced at the June Term 1817 in a suit in chancery wherein Matthew PATTONS heirs were complaining & said Thomas SPEED & others were left the said M. PATTONS Have recovered against the said Thomas SPEED two certain tracts or parcels of land hereinafter to be described, the one containing sixty four acres & one hundred & two poles & the other eleven acres & two poles, and whereas the Commissioners appointed by the said Court to value Improvements he having made and their report of the valuation of Improvements &c which is this day by virtual consent received & entered in Court whereby it appears the the Improvements on the land are valued to more than three fourths of the value of the land in its unimproved state and whereas the successful claim ants by Matthew PATTON & Patton D. HARRISON, two of the complainants & Matthew THOMPSON, Agent for the complts in this suit, have this day attended personally in said Court & agreeably to the provisions of the acts of assembly convening occupying claimants to land, made their election to convey the land to the said Thomas SPEED in preference to paying for the Improvements - now therefore the said Matthew PATTON & others of the first part do this Indenture in consideration of the sum of Seven hundred & sixty two dollars being the amount to which the land is valued by the said Commissioners, Secured to be paid by the bonds of the said Thomas SPEED this day executed & filed, have granted bargained sold and by these presents do grant bargain sell & convey to the said Thomas SPEED the aforesaid two tracts or parcels of land lying in Bullitt County & bounded as follows to wit, Beginning at a stake represented on the plat filed in Said suit by the letters & thence north five degrees west 80 ½ poles to D. a large poplar one of SPEEDS con___ thence s 76 E 69 poles to a stake at E, thence N 18 poles to a stake at F in the preemption line as patented, thence with the same N 65 W 9 poles to the line of the preemption by decree at G, thence w with the same 307 poles to the western boundary of the preemption by patent at H, thence with the same S35 W 95 poles to SPEEDS western boundary line at I thence with the same S 5 E 15 poles to the intersection of PHILLIPS Settlement line as originally surveyed at K thence with the same n 25 E 90 poles to the N. W. Corner of said settlement in BOWMANS line at _ thence with said settlement line s 65 E 171 poles to C the beginning containing sixty four acres &one hundred and two poles & being part of PHILLIPS Preemption also beginning for the second beech at said SPEEDS corner a yellow poplar fallen at the figure 1 on the said platt, thence N 5 W 127 poles to a stake in the line of Peter PHILLLIPS Settlement at the figure 2 on said p latt, thence with said line west 81 poles to a stake at the intersection of the settlement line at figure 3 on said platt thence with said line as patented S 25 W 28 poles to a stake in said SPEEDS Southern boundary line claiming under MYERS at figure 4 on said platt, thence to the Beginning being part of PHILLIPS preemption & containing eleven acres and two poles. To have and to hold the said two tracts or parcels of land containing in the whole Seventy five acres and one hundred & four poles unto him the said Thomas SPEED & his heirs forever together with all and Singular the appurtenance thereon & thereunto belonging to his & their only proper use benefit & behoof. And it is hereby covenanted & agreed by the Said Matthew PATTON and others of the first part of this indenture to & with the said Thomas SPEED, that if the land aforesaid shall hereafter be recovered from the said SPEED by any person claiming under an interfering claim paramount to theirs, that they the said Matthew PATTON & others shall & will refund to the said SPEED the sum of two dollars per acre without interest ___ as much as may be recovered. HARRISON two of the grantors named in the within Deed this day personally produced before me in my office and acknowledged the same as executed by them. Given under my hand at my office this 23rd day of September 1818 & on the twenty seventh year of the Commonwealth James HALBECK State of Kentucky Fayette County Towit October 12th 1818 This Indenture was this day produced to me the clerk of said County and acknowledged by Samuel RANKIN and Hannah his wife, Samuel MAXWELL and Margery his wife, Adam RANKIN and Sally his wife, Grantors therein named to be their act and Deed, and they the said Hannah, Margery and Sally being by me privately examined separate and apart from their said Husbands as the Law directs declared that they did of their own free will and accord sign execute and deliver said Deed without the persuasions or threats of their sd husbands (the contents of which having been read and explained to them) and that they are willing said Deed should be recorded and the same is hereby certified to the Clerk of the County Court of Bullitt County where the premises lie for Record. Att J. C. RODES Clk State of Kentucky Clarke Coutny Sct Clerks office October 26th 1818 I Christopher FRY Deputy Clerk for James P. BULLOCK, clerk of the court of the County aforesaid do hereby certify that this deed of Bargain and sale from the heirs of Matthew PATTON decd to Thomas SPEED was produced before me and acknowledged by John HUME and Esther his wife to be their act and deed and she the said Esther being by me privately examined Separate and apart from her said Husband as the Law directs declared that she did of her own free will and accord sign execute and deliver said Deed without the threat or persuasion of her husband (the contents of which having been read and explained to her) and was willing that the same shall be recorded and the same is hereby recorded Christopher FRY And on the 26th October 1818 before me Henry CHELES Junr deputy for James P. BULLOCK clerk as aforesaid personally came Benjm HARRISON and acknowledged the foregoing Indenture of bargain and sale to be his act and deed, and ordered to be Certified Henry CHELES Jun And on the 23rd Nov 1818 before me Christopher FRY Deputy as aforesaid Personally came James PATTON and Daniel HARRISON partees hereto and acknowledged the same to be their act and deed, and Benjamin PATTON, executor for Roger PATTON Decd also acknowledges the same to be his act and deed, and also Benjamin P. GAY as attorney in fact for John GAY, Thomas COPHER and Hetty COPHER acknowledges the same for himself and as attorney in fact for the said John GAY, Thos COPHER and Hetty COPHER to be his act and deed, and ordered to be certified Christopher FRY State of Kentucky Christian County Sct The foregoing Indenture of bargain & sale from the heirs & legal representatives of Mathew PATTON Senr Decd to Thomas SPEED, was on this 19th day of Dec 1818 produced to me John CLARK, Clerk of the County Court for the County aforesaid & acknowledged by William PATTON & Ann his wife grantors therein named to be their act & deed hands & seals for the Purpose therein contained & said Ann being by me examined separate and apart from her said husband declared that she freely Voluntarily & without the threats or persuasion of her said husband relinquished her right of dower in the land and Premises thereby conveyed & had no objection to the same being recorded, all of which is hereby certified In Testimony whereof I have hereto set my hand the date aforesaid Jno CLARK State of Ohio Ross SS Personally came before us the Subscribing two of the Justices of the peace in and for said County the within named Matthew PATTON, Samuel T. PATTON and Hetty PATTON his wife, Peggy PATTON, Sally PATTON, Ann PATTON, Polly PATTON, James MILLER and Rebecca MILLER his wife, who severally acknowledged the within Signing and Sealing to be their act and deed for the purpose and the foregoing conveyance _____, the said Hetty PATTON and Rebecca MILLER being by us examined apart from their said husbands acknowledged the within Signing and Sealing to be their voluntary acts, that they done the same without threats - coercion from their said husbands and that they are willing it may be committed to record. Given under our hand and seals the 12th day of June 1819 Arch d McCLEAN JP [seal] Wm CREIGHTON, JP [seal] State of Ohio Ross County -Sct I Humphrey FULLERTON Clerk of the Court of Common Pleas for the county aforesaid certify that William CREIGHTON and Archibald McCLEAN, Esqrs before whom the foregoing acknowledgement appears to have been taken and whose names are thereunto subscribed were at the time and are now acting Justices of the peace in and for said County duly commissioned and qualified. In Testimony whereof I have hereunto set my hand and affixed the seal of said County this 12th day of June 1819 and in the 17th year of this state. Given under my hand the date above written Green B. FRY And on the 25th of January 1821 before me James B. BULLOCK Clerk of the Court aforesaid came Benjamin P. GAY and acknowledged the same for himself and as attorney in fact for John GAY, Thomas COPHER and Hetty COPHER. Given under my hand the date above written James P. BULLOCK State of Kentucky I George P. SIMMONS deputy clerk of the County Court of Bullitt County do certify that on this day the within Indenture of Bargain & sale was produced to me in my office and being duly certified I have recorded the same with the certificates thereon indorsed in my said office as requires by Law.
