Deed Book F p. 255 John THORNBERRY, Benjamin W. THORNBERRY, Thomas WHITLEDGE who intermarried with Nancy THORNBERRY, now dec'd, Jonathan RIDGEWAY and Elizabeth his wife formerly Elizabeth THORNBERRY devisees and heirs of Frances THORNBERRY dec'd of the one part and Arthur QUINN and Mary W. his wife, William WILLSON and Frances his wife, Susannah COOMS, John COOMS and Matilda his wife, Edmund (or Edward) THORNTON and Eliza his wife and Russell K. THORNBERRY the devisees and heirs of the said Frances THORNBERRY deceased of the other part. Whereas Frances THORNBERRY dec'd the Testator of the parties hereto did by deed of trust bearing date 20 October 1819 recorded in Bullitt Co. to John BECKWITH and James CALDWELL in trust for the use and benefit of Wife Winney THORNBERRY and his children therein especially named two tracts of land and one negro man named Willy and one named Anthony and sundry articles of property therein named in Bullitt County. And whereas the said Frances THORNBERRY did afterwards remove to Jackson County and state of Illinois where he continued to reside at his death And whereas the said Frances THORNBERRY had acquired in addition to the eighty acre tract of land mentioned in his last will and testament the title to a tract of land in the county of Jackson and State of Illinois aforesaid on Muddy River containing Three hundred and Twenty acres and whereas the said Trustees named in the deed of trust aforesaid have since the death of said Francis THORNBERRY either departed this life or ceased to act in their official capacity. And whereas the said Winney hath since the death of her said husband disposed of the first tract of land mentioned in Deed of Trust lying in the County of Bullitt and sold negro slave therein mentioned by the name of Anthony with proceeds thereof purchased for the said devisees a tract of land in the County of Henderson and State of Kentucky also one negro woman named Nelly who has had since she was thus purchased four children namely Charles, Mary, Susan and Ann, infant now at the breast, And whereas some doubts are entertained by the parties hereto have the property of their deceased Testator should be devised among them for remedy whereof it is agreed between them that the party of the first part shall convey to the party of the second part the remaining tract of land in deed of trust also the tract of land in Henderson County, Kentucky and also the Negro woman Nelly and her four children in the room of Anthony named in the deed of trust aforesaid and all the personal estate named in the Deed of trust by Deed of Release and quit claim. And that the party of the second part shall convey to the party of the first part all right title and interest to the Three hundred and twenty acre tract of land in the County of Jackson, State of Illinois with all notes, bonds money in the hands of James HALL Sr. and James HALL Jr., Executors of the last will and Testament of the said Frances THORNBERRY deceased growing out of sale of the property in the State of Ilinois.
