Gaither et al Bullitt Circuit Court Decrees # 62 (v. 14) Bill filed 25 Dec 1815, Benj. EDWARDS on the 15 May 1780 entered 1000 acres to adjoin Henry TILLEN’s settlement & preemption on the upper side, which entry was surveyed 26 Oct. 1792 and patented to Ben EDWARDS 14 May 1794. The warrant for the 1000 acres was the joint property of Ben EDWARDS and Aaron BOTTS of Virginia, now deceased. BOTTS was to pay half the expenses and be entitled to a moity of one half the land when it was patented. BOTTS however failed to pay anything, nor have his heirs and EDWARDS makes them defts to this bill and prays that the court will require them to pay their share and accept a deed for their moity. Thompson BOTTS of Nelson County is the only heir of Aaron BOTTS that Edwards is sure of, although there are others back in Virginia, some infants and others Feme Covert. The principal suit, however, is directed against John R. GAITHER who has obtained a patent of elder date than EDWARDS for a part of the 1000 acres, made in the name of the afsd. GAITER. Also Phillip TROUTMAN who claims under GAITHER. GAITHER and TROUTMAN also claim another part of EDWARDS 1000 acres under another patent of elder date granted to Jeremiah TILFORD. Also the following persons claim parts of EDWARDS 1000 acres under the patent or patents granted to TILFORD: (1) SAMUEL SIMMONS (2) WILLIAM SIMMONS (3) JONATHONH SIMMONS, (4) HANNAH ROBERTS, widow of LEWIS ROBERTS,decd. (5) MORTIMER D. ROBERTS & GEORGE L. ROBERTS, of full age; & William ROBERTS, James ROBERTS, Alfred ROBERTS, Granville ROBERTS, Benjamin F. ROBERTS, Margeret ROBERTS, Eliza ROBERTS, & Robert ROBERTS, infant heirs and representatives of Lewis ROBERTS, decd. EDWARDS prays the court to require the above to relinquish their claim to the parts of his 1000 acres.
