U1 M KY James Shepherd's Will I James Shepherd of Bullitt County, Kentucky being of sound mind and difeusinf memory. Do hereby make and publish this my last will and Testament. Revoking all other wills hertafore published by me. 1st After my death. I desire my executors to pay all my debts and funeral expenses. 2nd I will and bequeth to my daughter Evaline Harshfield one dollar. Having heretofore given her a tract of land on which she formerly lived. I refer to the deed on record in the Bullitt County Clerks office to show the amount of land conveyed to her. I have also heretofore given and furnished her money and other property: it is thertofore my desire and will that she take nothing more out of my estate. 3rd I have heretofore given and deeded to my son James H. Shepherd the land on which he now resides. Consisting of several tracts. for the amount and boundary of said tracts of land given to my said son. I hereby refer to these several deeds Conveying said tracts of land. I also give and bequeath to him one seventh interest in my knob land herinafter mentioned. 4th I give and bequeath to my son Wm. H. Shepherd all my interest on the farm on which he resides. The same land conveyed to me by James Croan, to have and hold the same during his life. And after his death to his present wife, if she should be living and after her death to the living children of the said Wm. H. Shepherd. If none are living the said property shall go to my heirs at law. 5th I have heretofore given and deeded to my son Samuel Shepherd a tract of land lying on the north fork of Bullitt Lick Run, which is hereby changed to him as an advance meant for the number of acres and boundary of said land. reference is hereby made to the deed conveying said land. I also give and bequeath to him a tract of land containing about fifteen acres adjoining the above mentioned tract, the said fifteen acres includes the house in which he now lives, and is bounded as follows: Beginning at a stake and cedar near his stable on his line of the above mentioned tract. Thence eastwardly down a branch to two cedars. Thence southwardly to a red oak and still southwardly to a white oak. Thence westwardly to a white oak and ash in the Stansberry Oatin line. Thence northwardly to a white oak and stake at a line of the first tract above mentioned and with the samr eastwardly to a pine, thence northwardly to the beginning. I also bequeath to him one seventh interest in my knob land hereinafter mentioned. 6th I give and bequeath to my son John Henry Shepherd a tract of land lying on the north fork of Bullitt Lick Run. Containing one hundred acres more or less bounded as follows: Beginning at two pines and stake in Evaline Harshfield's line on a ridge, Thence with the path on the ridge westwardly to a corner black oakand chestnut oak near the path, thence southwardly down the drain to the cleared land on both sides that is fenced. Thence back to the drain and down the same to a sasafrass and black gum, thence westwardly to a pine, Samuel Shepherd's corner, and with his lines southwardly to a cedar near Samuel Shepherd's stable in his lines, thence eastwardly down the branch to two cedars thence southwardly to a red oak, thence eastwardly to a beech near the road in or near said John Henry Shepherd's line to his seventy - six acre tract, thence northwardly to a small white oak on the east side of the branch running north and south, thence eastwardly to two dogwoods near a branch and on the east side of said John H. Shepherd's line. Thence northwardly to a small water beech in or near the line of Evaline Harshfield and said John H. Shepherd, thence westwardly to a chestnut oak. Evaline Harshfield corner on the ridge said with her line northwardly to the beginning, there is included in this boundary about three acres which belong to the Shoptaw heirs. I do not claim the same. I have deeded this land to my said son. I also give and bequeath to the said John Henry Shepherd the sum of four hundred dollars to be paid to him as follows: To Wit: One hundred dollars by my son R. C. Shepherd, One hundred dollars by my son C. Q. Shepherd, and two hundred dollars by my son B. M. Shepherd the said sums shall become due and collectible one year after my death. The land devised to my said sons shall be bound for the payment of the aforesaid sums. These payments are required to make the said John Henry Shepherd equal with his brothers. 7th I give and bequeath to my son C.Q. Shepherd all that tract of land which he now lives known as the Henry Congrove tract except one and a half acres heretofore deeded by me to James H. Shepherd and that portion of the tract lying south of the Bullitt Lick road containing about sixteen or seventeen acres, which is herinafter devised to my dauhter Jeanette Milller. The said tract on that portion of land devised to the said C. Q. Shepherd, contains ninety - five acres more or less. I also give and bequeath to the said C. Q. Shepherd the following tract of land to Wit: Beginning at a stake near a mulberry on the south bank of the north fork of bullitt lick rub known as mudd run. Comes down the lines of B. M. Shepherd's tract hereinafter mentioned and with the same southwardly almost 80 yards to three cedars growing from one stump outside the fence. Thence southwardly with said fence to the corner of said fence, thence southwardly to the County road to the line of the Henry Congrove tract, thence with said line to the Mudd run creek. Thence with said run northwardly to the beginning containing about ten acres more or less. 8th I give and bequeth to my son R. C. Shepherd my four-fifths interest in ninety-nine acres of land known as the dower of Elizabeth Congrove lying on the north side of Salt river near the mouth of Bullitt Lick Run, being a part of the old Congrove tract 9th I give and bequeath to my daughter Jeanette Miller a tract of land on which she now resides bounded as follows: Beginning at a stake near a mulberry on the south side bank of the north fork of Bullitt Lick Run known as Mudd Run corner to the tract hereinafter devised to my wife and B. M. Shepherd and with the same southwardly about 80 yards to three cedars growing from one stump outside of the fence. Thence westwardly to a stake on the west side of Moore's branch at the front of a yellow bank, thence northwardly 56 yards to a forked Honey locust. Thence eastwardly about 25 yards to a stake on the east bank of said branch. Thence up the same northwardly to two cedars. Thence northwardly to two white oaks and still northwardly to two hickories on top of a ridge near a road and still northwardly to a white oak at Samuel Shepherds corner, in or near his line westwardly to a white oak ash line corner in or near Stausberry's line and with the same southwardly to Stausberry's corner in a line of the Bullitt Lick tract originally surveyred by Wm. Christian for 1000 acres and with the same southwardly to a fence. Isaac Moore's corner and with his lines westwardly to a stone. Moore's corner and in a line of said 1000 acres. And with the same southwardly about 39 E to the Wm. Daniel corner and with McDaniels line eastwardly to a sycamore on the bank of a branch and another line southeast to a cedar thence eastwardly to a stone corner to the original Congrove tract, thence northwardly to a stone Bullitts Lick Creek corner to the Henrry Congrove tract, thence up the creek with its meanders to the beginning. Out of the above boundary about one acre is excepted which I have given and decided to C. Q. Shepherd. I also give and bequeath to my said daughter all that past of the Henry Congroove tract situated south of the Bullitt Licks road containing about sixteen or seventeen acres more or less. It is my will that my said daughter shall hold the property devised to her heirs during her life and after her death the same shall go to her living children, but if she should die without having issue, that it is my will that said property shall revert to my lawful heirs. 10th I will and bequeath to my beloved wife Lucinda Shepherd the remainder of the tract bought of Wm. P. Johnson & wife heretofore willed, also that fortine of the Stausberry tract not disposed of in this will, which ordered the improvements where I now live during her life and after her death the same is to go to my son B. M. Shepherd who is to pay my son John H. Shepherd the sum of two hundred dollars one year after my death for land devised herein to my son B.M. Shepherd shall be bound for the payment of the said two hundred dollars. 11th All that portion of my knob land not disposed of by this will in the above mentioned devises. Which I may own at my death I give and devise the same equally to my sons James H. Shepherd, John H. Shepherd, C. Q. Shepherd, R.C.Shepherd, B. M. Shepherd, and Samuel Shepherd and my daughter Jeanette Miller. The tract of bought of Lewis heirs and the Cooper tract and not included in my knob lands. 12th I hereby appoint and nominate my sons John H. Shepherd and R. C. Shepherd executors of this my last will and Testament. In testimony whereof we have hereunto set my hand and seal Oct. 5, 1886 James Shepherd James Shepherd signed the foregoing statement in our presence at his request we have witnessed the same in his presence this the 5th of Oct. 1886 F. P. Straus Leon Straus State of Kentucky Bullitt County pct. I W. H. Ridgeway clerk of the Bullitt County Court in the state of Kentucky. Certify that on the 9th day of March 1891. The foregoing last will and Testament of James Shepherd deceased, was filed in court, and proved by the oath of F. P. Straus a subseen bring witness thereto have been signed and acknowledged in his presence, and in the presence of Leon Straus the other subseen bring witness by James Shepherd. The Testator to be this his last will and testament. and that theythe said witnessess attested same in his presence at his request, and in the presence of each other, and said F. P. Straus also formed the signature of, Leon Straus the other subseen being witness to his signature. The full capacity of mind of the testatorat the time of making said will was also formed, and the same being fully proved as by law required was ordered to be recorded, which within this certificate I have truly recorded in my office this the 16th day of March 1891 W.
