It is understood according to this settlement that the ballance due from the Executor in addition to the price for which negro JESS sold is the ballance of negro hire and rent of land as the last of said hire and rent was due. SMITH Exor including year 1851 394.73 WILLIAM SMITH Exor of JOHN SMITH sold negro man JESSE which Mrs. JERIAH WHITLEDGE had sold her dower right to JOHN SMITH & PETER SMITH and JOHN & PETERS Estates are entitled to interest on the sale money which was $512 at the death of old Mrs. WHITLEDGE four sixths of said negro belongs to JOHN SMITH’s estate, one sixth to JOHN B. SUMMERS which WILLIAM SMITH has paid him, one sixth to BOURBON J. WHITLEDGE of Missouri which WILLIAM SMITH is to pay and WHITLEDGE or his representatives and the ballance the Executor stands charged with at the death of Mrs. WHITLEDGE and also interest on one half of the $512 from 17 Dec 1844. By receipt of PERRY GILMORE filed herewith it appears in accordance with the will of decedent that on the 14 April 1849 WILLIAM SMITH, Exor, gave possession to said GILMORE who married MARTHA a tract of land at $750 and being 100 acres deeded decedent by ADAM SMITH also negro woman AMERICA & her child valued at $575 - in all $1325.00 The negro hire and rent of land for the year 1852 not yet accounted for as WILLIAM SMITH Exor. reported 274.00 I counted interest on notes in the Inventory to the time Exor says he collected interest on ALFRED THORNBERRYs debts s--- on is ---- to November 1849. I think according to this Settlement the Executor is charged with fully as much interest as he should be perhaps more. The widow of decedent had the use and profit of lands and negroes from the time of the decedents death up to her death which was in 1841. She was in October 1840 married to WILLIAM SMITH the Executor but never had her dower assigned --- to record and no notice has been taken by one of dower there is no charges by Executor for board until after death of widow when he charged himself with rents and hires as stated herein the Execuotr is due to said Estate on account of negro hire with its Interest as stated the sum of ballance $1186.44 Also sale of JESSE (and its interest) all of which is respectfull reported $341.43 more misc. business but no specific names mentioned. - all of this was recorded 20 Sep 1852 in Bullitt Co.
