Simmons Feb. 75 (the handwriting is very flowery and is difficult to read...I believe that is a 75 and not 15, based on other numbers in the will)... It is very old and not in the best condition...when you open it, you run the risk of having it rip...anyways, here is what it says, best as I can read it... the bad punctuation or spelling is not me, it's the way this was written.... In the name of God amen, I Thomas Simmons of the County of Bullitt and State of Kentucky being sick and weak in body But of sound mind and disposing memory Knowing the uncertainty of life and Certainty of death and being desirous of disposing of my earthley Estate as it hath pleased God to bless me with, I do hereby make ordain Constitute this my last will and testament (illegible) all (illegible). First. It is my will that all my just debts if any be paid, funeral expenses to. 2nd, I will and bequeath to my beloved wife Mary Simmons all of my property both real and personal moneys or otherwise during her widowhood. 3rd After the marriage or decease of my wife Mary Simmons I will and bequeath to my two sons Washington Simmons and Thomas N.(or W.) simmons the farm or tract of Land on which I now live Containing Two Hundred acres to be equally divided between them. The said to be divided the long way the said one hundred acres of Land give to my son Washington Simmons is for his services for amintaining and afeisting (???) me for the last five or six years, and the one Hundred acres given to my son Thomas N. (or W.) simmons on account of his afflictions he having nearly lost his eyesight. 4th I also give and bequeath to my son Washington Simmons one horse, saddle and bridle valued at $40. One feather bed and and furniture bedhead included and One Negro Girl named Malinda aged about7 or 8 years and her Natural increase to him and his heirs forever said girl valued at three hundred Dollars. 5th I also Will and bequeath to my son Thomas N. (or W.) Simmons Three hundred Dollars in money. One feather Bed and furniture. Also one mares saddle valued at $18 Eighteen Dollars 6th It is also my will after my death and the death of my wife Mary Simmons for my son Washington Simmons to have the management and Control of the One Hundred Acres of Land bequeathed to my son Thomas N. (or W.) Simmons for his maintainance and my son Washington is not to be bound to give security for said management and Control of said Land, and if my son Thomas N. (or W.) Simmons should die before he is or arrives at the age of Twenty one years then and in that case my son Washington Simmons is to have the said One Hundred acres of land so bequeathed or willed to my said son Thomas N. (or W.) Simmons 7th I will and bequeath to my Daughter Artimesia Simmons my Negro Girl named Mary and her natural increase if any to her and her heirs forever said Negro Girl being about 7 or 8 years old and valued at Three hundred Dollars, one feather Bed and furniture bedstead included. One Milch (?) Cow and One Woman's Saddle which she has now in her possession valued at Sixteen Dollars. 8th I will and bequeath to my Daughter Elizabeth Hall my Negro Girl named Civilla (?) Ann Her(?) 5 years old and her natural increase to her and her heirs forever and valued at Three hundred Dollars One feather Bed and furniture bedstead included One Milch cow which she now has in possession at the tim and 9th I also will and bequeath to my Daughter Minerva Simmons my Negro Girl named Charlotte about 10 months old and her natural increase to her and her heirs forever said girl is valued at Two hundred Dollars. also one Hundred Dollars in money, one feather Bed, bed head and furniture, One Milch Cow, and one Womans Saddle, the saddle now in her possession 10th I also will after my death and the death of my wife Mary Simmons that my Negro Woman Sarah and her natural increase from this date, and my Negro Man Charles to be equally divided among my children before mentioned to be sold publickly or otherwise as the may think proper, Also any household property that may be about (?) to be equally divided as above. 11th It is also my Will that so long as my two Daughters Artimesia and Minerva remain single or unmarried they are to live at my residence and it is to be to them a home during the time above specified. 12th And lastly I do hereby Constitute and appoint Robert Hall my lawful Executor with this my last will and Testament before named amnesced(???). Bogard John Lloyd State of Kentucky Bullitt county Court 15th August 1853 The foregoing last will and Testament of Thomas Simmons decd was this day produced in a peer(??) Court and proves by the oaths of Julius C.(?)Bukey Cornelius K.(or R.) Bogard and John Lloyd to be the last will and Testament of said decedent.
