He remarried Vena after my great grandmother's death, and after the divorce remarried again to Marie Miller Harris, another widow. Vena was a widow as well, entering the marriage with my great grandfather. Document Transcription: CIVIL ACTION NO 84-CI-085 BUTLER CIRCUIT COURT IN RE: THE MARRIAGE OF: VENA GARY PETITIONER VS. W.O. GARY RESPONDENT AGREEMENT This agreement being made and entered into this the 20th day of August, 1984 by and between Vena Gary, Petitioner, and W. O. Gary, Respondent. The parties state as follows: 1. That they have not acquired any personal or real property to be divided. 2. That the Petitioner, Vena Gary, has certain personal items in the home of the Respondent; that the Petitioner or her relatives or agent may have the privilege, at any time, to come into the Respondent's home, without interference, to acquire said personal items. 3. That the parties hereto make no claim against each other by reason of this marriage for support, alimony, or maintenance, now or ever. 4. It is further agreed between the parties that they have full knowledge of all the properties that they own; that neither have been misrepresented to or forced by direct or indirect means to execute the signing of this Agreement; that both parties agree that this Agreement; that both parties agree that this Agreement is not unconscionable and that they agree that this is a final and full settlement of all claims against each other growing out of this marriage and that this Agreement cannot be hereafter modified except by complete written agreement between the parties. 5. It is agreed by the parties that this Agreement shall be incororated by reference and made a part of this Final Decree of Dissolution of Marriage. W.O. GARY RESPONDENT FINDING OF FACTS, FINAL DECREE OF DISSOLUTION OF MARRIAGE AND JUDGMENT This matter coming on to be heard on motion of the Petitioner, the Court makes the following finding of facts: 1. That the Petitioner, Vena Gary, is 68 years of age; that she is now residing at Lakeview Nursing Home, Morgantown, Kentucky; that she is retired; and has been a resident of the Commonwealth of Kentucky for at least 180 days next preceding the filing of this action. 2. That the Respondent, W.O. Gary, is 82 years of age, that he is now residing at Welches Creek, Kentucky; that he is retired; and has been a resident of the Commonwealth of Kentucky for at least 180 days next preceding the filing of this action. 3. That the Petitioner and Respondent were married on March 8 1979 and their marriage license is duly recorded in Morgantown, Butler County, Kentucky. 4. That the Petitioner and Respondent have been separated since March 24, 1984. 5. That there were no children born of this marrage. 6. That the Petitioner, Vena Gary, is not now pregnant. 7. That there is no real estate owned by the parties to be divided. 8. That the Petitioner and Respondent have entered into an Agreement on August 20, 1984, settling all questions as to the distribution of their personal property and the question of support, alimony and maintenance. Said Agreement is incorporated into this Finding of Facts and shall be made a part thereof. 9. That this marriage is irretrievably broken and that they cannot reconcile their differences. FINAL DECREE OF DISSOLUTION OF MARRIAGE AND JUDGMENT This matter coming on to be heard on motion of the Petitioner for a Final Decree hearing and the Court being sufficiently advised, and the Court having made a Finding of Facts and concluding that all requirements of the law have been met, and the Court having jurisdiction over the parties, IT IS HEREBY ORDERED AND ADJUDGED: 1. That the marriage herein is irretrievably broken and the marriage of the parties hereto, namely, Vena Gary and W.O. Gary, is hereby dissolved, and that they are granted a Decree and Final Judgment of Dissolution of Marriage. 2. That the Agreement entered into between the parties on August 20, 1984 and filed in this Court, is hereby made a part of the Final Decree of Dissolution of Marriage and is incorporated herein.
