The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************** Source:KY State Archives Caldwell County Deed Book I,Pages 506-507 Mf #998253 Commissioner in Chancery to Dunklin,1840,Caldwell Co.,KY Tax Paid D.Caldwell to pay fee This indenture made and entered into this twentieth day of May in the year of our Lord one thousand eight hundred and forty between Johnson LAUGHLIN of the State of Kentucky and Caldwell County Commissioner in Chancery of the first part and Daniel DUNKLIN and Stephen T.DUNKLIN of the second part.Witnesseth that at the last March term of the Caldwell Circuit Court in a certain suit now pending therein in which said DUNKLIN's are plantiffs and John REID and others are defendants in Chancery a decree was rendered in which it is adjudged and decreed that said complaintants are entitled to the land in the bill and exhibits mentioned consisting of ___? several tracts entire containing by original survey and patent 200 acres granted to Cornelius MERZY assn? of George BYRUM,a tract of 400 acres adjoining the former on the south side Entered surveyed and patented in the name of John REID and a tract of 200 acres adjoining the last mentioned tract on the NE Entered surveyed and patented in the name of John HANNAH and also Eighty nine acres part of a survey of 150 acres patented to Charles STATON assn? of Jarvis HOUGHHAM and whereas it is farther ordered that said LAUGHLIN survey said land by the next term of said Court which survey hath been duly executed and report thereof herewith filed and that on failure of said defendants to convey said land to complainants on or before the next term of said Court that said LAUGHLIN be appointed a Commissioner in Chancery to make said conveyances wherefore said LAUGHLIN Commissioner of aforesaid,by virtue of the powers in him vested by the before recited decree hath this day and doth by these presents transfer alienate enscoff convey and confirm unto said Daniel DUNKLIN and Stephen T.DUNKLIN the whole of the lands to them so decreed situate lying and being in the State and County aforesaid on the Sinking Fork of Livingston Creek and Donaldson's fork of Tradewater which when united by recent survey contain about one thousand and forty acres. Bounded as follows to wit. Beginning at an Ironwood and Sugartree N.W.corner of a tract of 89 acres conveyed by Charles STATON to John REID standing on a branch 6 poles south of the original line running thence S.5 W.184 poles to a black oak and hickory SW corner of said 89 acres in the first line of John REID's 400 acre survey thence with said line N 65 W 26 poles to a black oak thence S 20 degrees W 160 poles to a black oak and hickory in a line of David CALDWELL's survey thus far binding on the lands of Wm.WYATT thence with said CALDWELL's line N 80 degrees E 56 poles to two hickories corner thereof ,thence S 28 degrees E 108 poles to Kinsey ROBINSON's line (the three hickories called for not found) thence with said line N 51 E 162 poles to his corner two black oaks,thence with a line of another survey belonging to said ROBINSON N 46 E 56 poles to three post oaks and black oak corner thereof;thence with another line of the same S 47 E 40 poles to a black oak (not found)thence N88 E52 poles to a white oak not found thence S25 E180 poles to a black oak & hickory,N89 E66 poles to a white oak & hickory;N30 E135 poles to two black oaks and a hickory twelfth corner of John REID's survey and fourth corner of John HANNAH's,thence with said HANNAH's line N34 E varying degrees E. from the call of the patent 173 poles to a white oak said HANNAH's beginning corner;thence N63 W230 poles to a Spanish Oak;thence S27 W150 poles to where this line intersects a line of John REID's survey;thence with said line N55 W6 poles to a black oak REID's and BRYAN's corner;thence with BRYAN's line S5 E200 poles to a white oak corner thereof;thence N85 W284 poles to the beginning passing a post oak corner to said BRYAN & HOUGHAM at 204 poles. With all its appurtenances to have and to hold the whole of the before described united tract of land composed of the several tracts aforesaid with the exceptions herein after excepted with its appurtenances to the said Daniel DUNKLIN and Stephen DUNKLIN and to their heirs and assigns forever. And the said LAUGHLIN Commissioner as aforesaid so far as his powers as Commissioner enable him doth by these presents bind said defendants severally agreeable to the terms of their original contracts as shown in the exhibits filed in the before recited suit to warrant and forever defend title to the before described land and premises to said DUNKLINs their heirs and assigns against the claim or claims of themselves their heirs and all and every person or persons whatsoever legally claiming or to claim the same or any part or parts thereof. But it is particularly understood between the parties hereto,that two acres around a Meeting house and one acre on a knob for a graveyard with the privilege of a Spring be and the same is hereby excepted. In testimony whereof the said LAUGHLIN Commissioner as aforesaid hath hereunto set his hand and affixed his seal the day and year first written. Johnson LAUGHLIN Commonwealth of Kentucky,Caldwell County & Circuit Sct. I Re? H.J. DAVIDGE Clerk of the Caldwell Circuit Court for the County and Commonwealth aforesaid do hereby certify that the foregoing Deed of bargain & Sale from Johnson LAUGHLIN Commissioner in Chancery to Daniel & Stephen S.DUNKLIN was on the 23rd day of May 1840 produced in open court and acknowledged by said LAUGHLIN Commissioner as aforesaid to be his act and deed brand & seal for the uses and purposes therein mentioned,and the same was ordered to be recorded and certified to the Clerk of the Caldwell County Court for record.
