I Levin Oliver of the County of Caldwell and State of Kentucky, being of sound mind and Memory, and knowing that it is appointed of God for all men once to die, do make, ordain, constitute and appoint this my last Will and Testament, and desire it to be received by all as Such. First I desire that my body be buried decently interred, without ?? or parade. Secondly, I desire that all my worldly debts, which are few, be justly paid. Thirdly I will and bequeath to my beloved wife Elizabeth Oliver the Tract of land on which I live, supposed to be Twenty acres, to her entire use & benefit, during her natural life. After her death I desire that the said Land descend to my Grandson Joseph Olliver, son of Josies Olliver. And that the said Josies (^after her death or aft) have the entire use & benefit of the sd premises, until said Grandson becomes of age. Fourthly I give and bequeath to my said Wife, all stock of every description, all my farming utensils, house-hold and Kitchen furniture to be hers during her natural life. And after her death I desire that the sd property be sold to the highest bidder, and the proceeds thereof equally divided amongst all my Children (Towit) Nathan Olliver, Leonard Olliver, William Oliver, Hezekiah Oliver, Cornelius Oliver, Elizabeth Cummins, Levin Oliver and Josies Oliver. Fifthly I appoint my Wife Elizabeth Oliver and my son William Oliver Executrix and Executor of this my last Will and Testament and request that no security be required of them as such. In Testimony that I do Acknowledge this to be my last Will and Testment I have fit my hand and affixed my Seal this 26th day of May 1830. The written last Will and Testament of Levin Oliver decd produced in open court and proven by the Oath of William Mercer as suscribing? Witness thereto, and the form? was thereupon Ordered to them. In Testimony thereof and that I have truly recorded the form together with this Certificate in my Office, I hereunto let my hand as Clerk afsd Court, this 19th day of July 1830. N. L. Dallam Clk Additional Comments: NOTE: People have seen the name Josies/Josiah/Josier in various ways. The abstract of this will in "Pioneers of Caldwell County Kentucky, Volume I, Probate Records of the Original Settlers 1809-1834 by Olive Eldred and Nancy Beck” refers to this person as Josie Oliver, and then assumed she was a daughter. Even they read the witness as Josiah Oliver however.
