W. Duncan by way of mortgage one sorrel horse ball face 6 years old last spring, 1 bay mare nine years old, one two horse wagon and rigging to have and to hold. The aforesaid horse wagon and rigging I hereby warrant and defend against all claims whatever, now if xxx well and xxx paid said debt then this obligation to be void, else to remain in full force. Davis clerk of the county court in and for the county and state aforesaid do certify that this mortgage from John Cannafix to L. W. Duncan was this day produced to me and my office and was duly acknowledged by the said John Cannifax to be his act and deed for the purposes therein outlined and whereupon the said mortgage together with this certificate have been duly admitted to record in the office and stamped according to law given under my hand this 12th Day of December 1870. Cannafix the interest I have in a suit pending in the Carter Circuit Court as Executor of Leroy Duncan deceased against the estate of Calvin Cannifax and RiceRoy Cannafix to subject a tract of land in Carter County on the waters of Tygarts Creek to the payment of the purchase money and whereas said Cannifax prepaid and secured to be paid the sum of two hundred and fifty dollars now in consideration of the said xxx, in case said Cannifax shall fail to make the money aforesaid out of the land, xxx I hereby sell and convey by way of mortgage to certain tract or parcel of land lying on the waters of Tygarts Creek in Carter County containing about eighty acres the same I now live on. To John S. Cannifax, his heirs and forever I hereby warrant and defend against all claims whatever. Now should I well xxx pay and falisfy the xxx aforesaid and all costs and damages in case said land should not be subjected to this payment of laid debt or recover their xxx obligation to be void else to remain in full force and I bind myself to cause a good and sufficient deed to be made to said land this 12th December 1870 L.
