CARTER COUNTY, KENTUCKY - DEED - DICKERSON, MARY-RUCKER, ELZAPHAN Jr. HEIRS (1870) From: John Rucker - email: mican@iwaynet.net d2620001.txt Carter County, Kentucky Deed Book 1, Page 328 9 May 1887 RECORD OF COMMISSIONER'S DEEDS WHEREAS, in the action of Mary Dickerson and others, Plaintiff, against Elzaphan Rucker, Jr's heirs and others, Defendant, then pending in the Carter County Court, for the partition of the real estate of Elzaphan Rucker Jr, deceased, an order was entered at the October Term, 1886, directing S.L. Bays, Wm. Everman, & Jas. E. Fields, as Commissioners of said Court to make a division and allotment of the said real estate between the parties to said action, and the said real estate was divided in accordance with said order, and said Commissioners having made their report of division at the Dec. Term, 1886 of the said Court, their said report was then by a further order of said Court approved and confirmed, and on the 11th day of April, 1887, the said Court appointed the undersigned Thomas W. Mitchel a Special Commissioner to make deeds or partition, conveying to each party the lands and property allotted to them in severality. Now, Therefore, this Indenture, made and entered into this 9th day of May, 1887, between Mary Dickerson, John E. Humphries, Absolom Rucker, S. Jane Guthrey, Christina Blackwell, Mary Herbron, Audsen Rucker, Elzaphan Rucker & Martha Rucker by Thos. W. Mitchel, Commissioner aforesaid of the first part, and Mollie Rucker, Maggie Rucker, Wm. Rucker, Lizzie Rucker, Harry Rucker & Wade Rucker of the second part. Witnesseth that for and in consideration of the premises, and in obedience to said order, the part of the first part, by Thos. W. Mitchel, Commissioner aforesaid, have sold, and do hereby convey to said parties of the second part and their heirs and assigns forever, the Lot No. 2, described as follows, viz: Lying in Carter Co Ky, on the waters of Little fork of Little Sandy. Beginning on two(2) pines on top of a ridge SW corner of Lot No.1, thence North a line of ??? N 48 W 106 poles to a stake in the West line of Lot No. 1. Near a fence N 58 E 40 poles to a chestnut oak, small hickory & black oak Corner of Lot No. 1. S 63 3/4 W 9 1/2 poles to a small white oak & blk oak S 57 1/2 W 2 poles to 2 blk oaks & gum.
