CARTER COUNTY, KENTUCKY - DEED - FALIN, MALINDA-MARY COAL COMPANY (1891) From: Becky Falin, 1991 f4500001.txt Carter, KY Land Records 12 October 1891 This Agreement made this the 12th day of October, 1891 by and between Malinda Falin, wife of Martin Falin Dec. party of the first part and Mary Coal Co. by their Agent Wylie Prichard party of the second part all of the County of Carter and State of Kentucky Witnesseth that the partof the first part for and in consideration of the sum of seventy-five dollars to be paid in merchandise at the said Company's store. Fifty dollars of which is to be paid at this date and the remaining Twenty-Five dollars to be paid the 1st day of March 1892 and the further consideration that the said party of the second part lease to the party of the first part for the term of fifteen years for farming purposes alone no wastes to be commited or allowed to be commited on the said premises the following described parcel or tract of land. Beginning at the branch near the company's old shop thence a S W course up the middle of Point to the dividing ridge between Davy's ??? and said branch being first point below where John Arms now lives thence with middle of ridge to the waters of Crooks Creek to the county road then with County road as North Easterly direction to the first point where the old haul road is thence down the center of said point ot the branch as to include the house where John Jacobs now lives. The said party of the first part forever releases and discahrges the said party of the second part from all legal obligations and liabilities resulting from the accident or death of her husband, Martin Failen while working in mines of party of the second part. There is further consideration in this contract that the said party of the second part release and discharge all indebtedness now shown to exist on Co.s books against Martin Failen and Sherman Failin. Said party of the second part to give possession of said land by the 10 day of March 1892. In witness where of we hereunto set our hands and seals. Given under my hand this the 12 day of October, 1891 1893 State of Ky; County of Carter Personally came before me, a deputy clerk for county and state aforesaid William A Banfield, age 53 whose address is Denton, Carter co., Ky who having duly sworn states that he moved in the neighborhood near where Malinda Falin, the widow of Martin Falin then lived in the year of 187? and that one of his boys was then a child of about one year old and know Tressy Falin was then a small child about the age of my child and ??? now state that she is now seventeen years old her last birthday to the best of my knowledge and i further state that in making the above statements I have not used and was not aided or prompted by any written statement or printed statement or recited proposed or dictated by any other person and such testimony was written in my ???? and from my oral statements made to N V Raisen.
