Civil War Pension of Larkin Leathers' widow and children State of Kentucky Casey County On the eighth day of June AD 1865 personally appeared before me A I Giboney presiding Judge for the County Court Casey in the State of Kentucky Sarah J Leathers a resident of the County & State aforesaid aged 35 years who being first duly sworn according to law does on her oath make the following declaration in order to obtain the benefit of the provision made by the Act of Congress approved July 14 1862. That she is the widow of Larkin Leathers who was a private in Company I commanded by Capt John Dever in the 8th Regiment of Kentucky Volunteers in the War of 1861 who died in the line of his duty in the service of the United States on the 16th day of April AD 1863 at Camp Clarksville Tenn Hospital of inflamation of the brain or Brain Fever & she has no knowledge where the Physician moved who attended the SD deceased. She further declares that she was married to said Larkin Leathers on the 11th day of May AD 1862 that her husband the aforesaid Larkin Leathers died on the day above mentioned and that she has remained a widow ever since that period as will more fully appear by reference to the prove hereto annexed. She also declares that she has not in any manner been engaged in or aid or abet the rebellion in the United States. Also she furthers declares that the above named Larkin Leathers at his death left five infant children viz Mahala J born Oct 19th 1849, Frances M born November 24th 1857, Wm F born March 22nd 1853, John A.C. born February 2nd 1856, Alfred R born January 6th 1858 these children was by a former marriage of the sd Larkin Leathers and the mother of the sd infant children the above named ______________________________________________________________ I J W Wash clerk of the County Court for Casey County & state aforesaid certify that A. State of Kentucky Casey County On the 16th day of May A D 1866 personally appeared before _____ presiding Judge of the County Court in and for the said County John Dever a person whom I certify to be respectable and entitled to credit & a resident of the County & State aforesaid who being duly sworn by me according to law says that he was Captain of Company I in the 8th Regiment of Kentucky Cavalry Volunteers that Larkin Leathers was a Member of said Company & Regiment enlisted by him in the Service of the United States in the War of 1861 and when enlisted & mustered into the sd service he was physically sound in body that whilst in the Service of the United States and in the line of his duty he was taken suddenly sick while the Army was Stationed at Clarksville Tenn. I had the physician of the Army to examine him who reported that his disease was such Brain Fever, that he feared he could not long survive and from his advise I ordered him to be taken to the Post Hospital of the Regiment where he died in a short time in the line of duty & did not see him any more but from the report of those of the Company I am satisfied he died of said disease. Major Patterson of the 17th Regiment of the Kentucky infantry was the Post Surgeon and Morrison was the Batalion Surgeon and dr live in or near Clarksville Ky where he now lives he is unable to state. He has no knowledge of the whereabouts of Major Patterson his death was on the 16 day of April ADF 1863. And that I have no interest whatever in the prosecution of this claim. J. Says that he was well acquainted with Larkin Leathers who was a private in Company I commanded by Captain John Dever in the 8th Regiment of Kentucky Cavalry Volunteer in the War of 1861 who died at Clarksville State of Tennessee on or about the 16th day of April in the year 1863 of brain fever in the line of duty in the service of the United States. He further swears that he was a Member of Company F of the aforesaid Regiment happened to be in Leathers Company in camp when Leathers was taken sick with severe vomitting & cramping of the stomach and he lay in that condition he thinks some 24 or 36 hours feeling an interest in Leathers he had a conference with Dr. Morrison the batallion physician who informed him that the disease of which Leathers was afflicted would terminate in brain fever after this conversation Leathers was taken to the Post Hospital of the Regiment and he in passing through the sd Hospital saw Leathers in sd hospital several times still lingering under his disease and on the day that Leathers died he was present & saw him die in sd hospital & saw him laid out for dead by the steward of the Hospital but was not called off and was not present at his Leathers burial. Had a conversation with the steward of the Hospital after Leathers was Laid out who told him that with Dr Mitchell the post Surgeon of the Regiment (& who was a member of the 102 Regt Ohio Infantry Vols.) informed him the Surgeon that the disease Leathers had labored was Brain Fever. He further swears that Leathers died in short time after he was attacked with sd disease. He has no _________________________________________________________________ knowledge ____________________________ Dr. Mitchell knows that Dr. Morrison _________ Clarksville Tenn but does not know that he is there now. Knows that the applicant Sarah J Leathers is unmarried & continued to be the widow of sd Larkin Leathers Decd and resides in Casey County Kentucky. Underlines and the appearance of an erasure in the names of Morrison & Mitchell was done before signing the same together with other erasures and that he has no interest whatever in this claim. Stanford Ky Oct 31, 1876 Commission of Pensions Washington DC Dear Sir, Some years since my step mother as the widow of Larkin Leathers Decd late a private in Company I, Capt Devers, 8th Regt Ky Cavalry Col Shackleford filed her application as the widow of said Leathers for pension and the same was granted and she drew a pension until she married again. I wish to know whether my step mother drew a pension for any of the children of my father by a former wife. I have two brothers and two sisters all of whom were under 16 years of age at our fathers death. But did not live together after our father went into the army. I give the ages below of said children. Blain Stanford, Ky ARG Commonwealth of Kentucky Lincoln County Court December Term Dec. 4th 1876. In the matter of appointing Guardian for Alfred Riley Leathers. This day Alfred Riley Leathers a minor over 14 years of age, appeared and chose and asked the Court to appoint James K Helm his Guardian; wherefore it is ordered by the Court that said James K Helm be and he is hereby appointed Guardian to Alfred Riley Leathers, and that he be now required to qualify as such according to law; and thereupon said James K Helm was sworn in open Court as the law directs, and he with William Leathers, his surety, executed a bond with proper conditions to the Commonwealth of Kentucky of Kentucky, which the Court approved. Helm is now the acting guardian of Alfred Riley Leathers. D. one thousand eight hundred and seventy six personally appeared before the undersigned J Blain Clerk of the County Clerk in and for the County and State aforesaid. James K Helm, a resident of Lincoln County Kentucky aged 30 years who being duly sworn according to law doth on oath make the following declaration as guardian of the minor children of Larkin Leathers deceased in order to obtain the benefits of the pensions offered by the Act of Congress approved July 24, 1862 and amended Act of July 25, 1866 & other acts and amendments granting pensions to minor children under sixteen years of age of deceased officers & soldiers. That he is the guardian of Alfred R. Leathers minor child of Larkin Leathers (his ward) deceased whose father was a private in Company H Capt Devers in the 8th Regiment of Kentucky of Kentucky Cavalry Volunteers in the War of 1861. And that the said Larkins Leathers the ____________________________________________________________________ the soldier died at Clarksville Tennessee on the 17th day of April 1863 from disease contracted in the service. That the mother of said children died years ago & to whom their father was married on the 13th day of January 1848 in Casey County, Ky. And that the father of his said ward again married and left a widow, step mother of his ward, Sarah J. Leathers to whom as the widow a pension certificate was granted Number 84071 Sept 22, 1866 commencing April 17, 1863 and ending Sept 21, 1870 the date of her remarriage. That she is still living & a married woman, that she never drew any pension for the minor children of said Larkins Leathers Decd. That his said wards are entitled to pensions from the date of the widows remarriage and also each minor child is entitled to the avortimal sum of two dollars per month from 25th July 1866 until the arrival at the age of 16 years. That the following are the dates of the births and ages of the children of the soldier living by his first mar ____________________________________________________________________ riage (said soldier left no children by the second marriage) to wit: Mahala Jane Leathers, born Oct 17, 1849 Frances M Leathers, born Nov 24, 1851 William Leathers, born March 22, 1853 John A. He further declares that the parents of his said ward were married in Casey County, Kentucky on the 13th day of January 1848 by John D Steel a minister of the Gospel. That the first wife of said Leathers, Amanda Leathers died in Lincoln County, Kentucky on or about the Day of August, 1858 and he remarried 11th day of May 1862 and in the same year enlisted in the army & died in the spring of 1863 and his children became scattered and were taken by friends and provided for by other persons than the widow Sally, the second wife. They further state that the step mother never after the death of the father, never had the care control or custody of the children of said Larkin Leathers and affiants further say that they speak of their own personal knowledge as to the care, custody and control of the children being neighbors and well acquainted with the condition of the family and they have no interest in the claim direct or indirect W. Leathers who being duly sworn according to law upon their oath say that they are children of Larkin Leathers Decd by his first wife. That their father entered the military service of the United States at Russellville, Ky as a private in Co. I 8th Regt Ky Cavalry Volunteers on the 8th day of September 1862 and died while in said service on the 10th day of April 1863 at Clarksville in the State of Tennessee. That their step mother, widow of their father made an application for pension and a certificate of pension at $8. per month was granted her and that she continued to draw said pension from the death of their father until her remarriage on the day of 187 . Applicants with the other children of said Leathers by his first wife make this application to recover the arrears of pay of pension due them as children of the soldier from remarriage of the widow until attaining 16 years of age and the two dollars each per month from the 25th day of July 1866 under act of Congress granting pensions to widow and minor -------------------------------------------------------------------------- children under 16 years pay to the widows & children of deceased soldiers. They refer for particulars of service time of enlistment and death of soldiers to the muster and pay rolls & others papers on file in proper office at Washington for evidence in support of their claim and they hereby appoint Robert Blain of Stanford, Lincoln County Kentucky their attorney to prosecute and present this claim. Leathers, who being first duly sworn according to law makes the following declaration for the purpose of obtaining the benefits of Act & amended Act of Congress granting pensions to the minor children of deceased officers & soldiers of the War 1861-2. That he is one of the children of Larkin Leathers Decd late a soldier Co. I 8th Ky Cavy Vol. That his father enlisted at Russellville Ky about the 8th day of Sept 1862 and died at Clarksville, Tenn 10th day of April 1863. He states that his brothers have made also applications for the benefits of the provisions of said pension Acts and he makes this his application as required by the Commissioner of Pensions and he refers to the proof as to his age - services & death of his father & proof furnished by his step mother in her application for widows pension. And such other papers as may be found in pension office in support of his claim. That the following children were under 16 years of age at the time of his death and the only minor children of said soldier living under 16 years of age at the time of his death. Which accured at Clarksville Tennessee on the 10th April 1863. To wit Frances M Leathers born Nov. 24, 1851 William Leathers born March 22, 1853 John A. C. Leathers born Feby 2, 1856 Alfred R. Leathers born Jany 6, 1858 Affiant states that the above are the true dates of the births of each of the above named children. That she was present with the mother in the capacity of assistant nurse at their births and speaks of personal knowledge as to the dates & that she has no interest in the prosecution of this claim whatever. That she was present with the wife of said Leathers at her encouchment, when one of her children was born in the capacity of midwife, and states from her personal knowledge that said son William was born in Milledgeville, Ky Lincoln Co. on the 22nd day of March 1853 and that she has no interest in the prosecution of any claim that the children of Larkin Leathers Decd may have against the United States for the military services of their father. D. one thousand eight hundred and seventy- Seven personally appeared before me Clerk of the County Court the same being a court of record within and for the county and State aforesaid, James K Helm a resident of Milledgeville, county of Lincoln, in the State of Kentucky, aged 32 years, who, being duly sworn according to law, makes the following declaration in order to obtain the pension provided by Acts of Congress for children under sixteen years of age: That he is the only legal guardian of Alfred Riley Leathers minor child of Larkin , legitimate children of Larkin Leathers who enlisted under the name of Larkin Leathers at Russellville Ky, on the 8 day of Sept, A. D. 1862 in the war of Rebellion of 1861-2&, who died at Clarksville Tennessee at Clarksville Tenn, on the 8 day of April, A. D. 1863 and who bore at the time of his death the rank of Private, in Company I, 8th Regt Ky Cav that he left a widow surviving who has remarried that the above named are the only legitimate children of said Larkin Leathers who were under sixteen years of age at the time of his death, of whom Alfred Riley, John A. C. William, Frances M. are still living. That said children were the issue of said soldier, the dates of their birth being as hereinafter stated: Frances M, of soldier by , born Nov 26, 1851 William, of soldier by , born March 22, 1853 John A. C., of soldier by , born Feb 2, 1856 Alfred Riley, of soldier by , born January 6, 1858. That the father was married under the name of Larkin Leathers to Amanda Vaught/ mother of applicant there being no legal barrier to such marriage; that the said children have not aided or abetted the rebelion; and that a prior application has been filed by the widow & pension certificate granted her . That she was personally well acquainted with Larkin Leathers Decd late of the military service of the United State and with his family including all his children by his first wife and with the wife. She states that the following are the dates of the births of his children. Frances M Leathers born Nov. 26, 1851 William Leathers born March 22, 1853 John A. C. Leathers born Feby 2, 1856 Alfred Riley Leathers born Jany 6, 1858 That affiant was present at the birth of the above named children in the capacity of assistant in waiting on the mother. She states that the above dates of the births of above named children are taken from the family record in her possession. That the mother of said children died in Lincoln County near Milledgeville on the 21 day of June 1859. That affiant speaks from personal knowledge as to the dates of the births of _____________________________________________________________________ within named children and also as to the dates of the death of the mother. Sir, In the pension claim of the heirs of Larkin Leathers No. 229192 the dates of the pension commences Sept 22, 1870 the time of the widows marriage. The widow drew a pension from husband death until her marriage Sept 27, 1870. The widow never drew anything for the children of the soldier ____ Act 25 July 1866. Four of the children are under 16 year of age at that date to wit. Frances M was 16 24 Nov 1867 William was 16 22 March 1869 John was 16 Feby 2 1872 Alfred Riley 16 Aug 6 1874 Why does not this pension allow them 3 per month from July 25 1866 until they each attain 16 years.
