Kentucky Vol. E Madison County, Kentucky Land Records Pages 547, 548 and 549 Hamm to Smith This indenture made this 17 day of September and in the year of our lord one thousand eight hundred and three Between William Ham of Madison County and state of Kentucky of the one part and Thomas Smith of the County and state aforesaid of the part Witnepeth that the said William Ham for and inconsideration of the sum of forty seven pounds twelve shillings Current money of this common wealth to him in hand paid the receipt whereof he hath hereby acknowlidged and acquit hath bargained sold and convey and by these present do Bargained sell and convey to the said Thomas Smith one certain trait or parcel of land lying and being in the locality of Madison and on Silver Creek Containing by estimation Sixty seven and one quarter acres be the same more or less and bounded as follows. Niz Begining at a black locust on the bank of the creek in a line of a survey formerly belonging to William Holland Running from thence a new line an East course croping a field thirty seven poles to a small Hickory thence North six poles thence east sixty four poles to a white oak and hickory in a line dividing lands belonging to said William Ham & Green Clay thence with said line North one hundred and two poles to a white walnut on a branch thence down the meandew of said Branch North fifty degrees west Eighteen poles thence west fourteen poles thence north Eighty degrees west sixteen poles thence west 30 poles thence south fofty eight degrees west forty poles to three Elms at the mouth of a branch in a line of Many phelps suniy thence up the meandew of the creek south twenty six poles thence South ten degrees west six poles thence South twenty and an half poles thence with a right line to the Begining to have and to hold the tract of land with its appertenances unto the said Thomas Smith his heirs or afsigns forever and the said William Ham doth Covenant and agree to and with the said Thomas Smith that he the said William Ham his heirs & will warrant and forever defend this right of the above sold land and premises with the appertenances there to belonging against the claim or claims of all and every person or persons Whatsoever unto him the said Thomas Smith his heirs or afsigns forever and this Indenture further Witnepeth that Elizabeth Ham wife of the sd Wm Ham for the Consideration above mentioned doth also make over and do relinguish her right of dower to the said Sixty 7 1/4 arces of land and premises on Witnepeth the said William Ham and Elizabeth his wife doth hereby set their hands and seals the day and year first above written Teste William Hamm S.
