Kentucky Pages 204 and 205 Daniel Steward | Indenture to Isaac Taylor | This Indenture made and entered into this 12" Day of November in the year of our Lord eighteen hundred and thirty three between Isaac Taylor of the County of Clay and State of Kentucky of the one part and Thomas Smith and Polly his wife Paul Henson and Margaret his wife Daniel Steward and Sarah his wife Moses Jones and Kisia his wife Robert Smith and Frankey his wife of the other part Witnesseth that for and in consideration of the sum of thirty five Dollars to each in hand paid by the said Isaac Taylor the receipt whereof is hereby acknowledged have granted bargained and sold unto the said Isaac Taylor all our right title and interest as heirs and devisees of Thomas Smith deceased to two tracts of land Setuated on Goose Creek lying and being in the County of Clay and Patented in the name of Thomas Smith in which he resided during his life time. The other adjoining tract patented in the name of Thomas Smith and Hugh White purporting to be one hundred acres one moiety of which together with the first named tract the said Smith deed seased and possessed of. Now we the above name heirs and devisees of the said Thomas Smith deceased do by these presents sell and convey to the said Isaac Taylor all our equal and undivided interest in and to the aforesaid tracts of the lands for the consideration aforesaid with these appurtenances to have and to hold the said tract or parcel of land with their appurtenances to the said Isaac Taylor and his heirs forever and the said heirs and devisees above named doth warrant and defend the title of the aforesaid tract or parcel of land to the said Isaac Taylor and his heirs forever from the claim of ourselves our heirs and every person or persons whatever claiming under by or through us But it is agreed and understood by the contrueling parties that in the event the land should be lost by any person or better claim whatever the grantors are not to be responsible for the whole or any part of the consideration In testamony whereof we have hereunto set our hands and seals the day and date first written Daniel Steward (Seal) Sarah x Steward his wife (Seal) Thomas x Smith (Seal) Polly x Smith his wife (Seal) Robert x Smith (Seal) Frankey x Smith his wife (Seal) Commonwealth of Kentucky Clay Clay County set.
