CARTER and SALLY his wife to JAMES T. WILLIAMS This Indenture made and entered into this 3rd day of January 1850 between CHARLES G. CARTER & SALLY CARTER his wife (formerly SALLY HAGGARD), of the County of Warrick & State of Indiana of the first part & JAMES T. WILLIAMS of the County of Cumberland & State of Kentucky of the Second part Witnesseth. That the Said CHARLES G. CARTER & SALLY CARTER his wife for and in consideration of the sum of eight hundred Dollars to them in hand paid by the Said WILLIAMS the receipt whereof is hereby acknowledged have this day granted bargained Sold & Conveyed unto the said WILLIAMS a certain tract or parcel of Land Situate lying and being in the County of Cumberland and State of Kentucky on HAGGARDS branch Containing 327 acres be the Same more or less being lot No. 4 in a division of lands between the heirs of BEN HAGGARD Dec’d made by GEORGE DOHERTY, JAMES RITCHEY & JEHU MILLER Commissioners chosen by Said heirs under an agreement recorded in the Office of the Clerk of the Cumberland County Court in Deed book K, page 553 Said division accompanied by a connected plat of the lots assigned to the respective heirs of BEN HAGGARD is recorded in the office of the Clerk aforesaid in Deed book K, page 556-557 & 558 and for greater certainty is hereby refered to and made part of this deed Said lot No 4 in the Division aforesaid which is hereby sold & conveyed, was assigned by the Commissioners aforesaid to Said SALLY CARTER then SALLY HAGGARD & is bounded as follow towit – Beginning at a beech on the west side of a point near the Burksville road and corner to lot No. 3 thence with a line of No 3 N 9 W 135 poles to a white oak and bounded thence N 81 E 70 poles to a hickory and hornbeam thence S 45 E 50 poles to a hickory and ash N 81 E 61 poles to two hickories thence leaving the lines of No. 3 N 39 E 22 poles to an ash thence S 78 E 40 poles to a black oak two hickories thence S 8 E 18 poles to a black oak & two chestnuts oaks corner to JOHN E. KINGS 350 acre Survey thence S 58 E 18 poles to a white oak & poplar thence S 10 W 115 poles to a hickory & Sugar tree thence with the line of a survey made for DAVID McNAIR S 44 E 36 poles to a beech corner to the WIDOW McNEELY’s 100 acre Survey & with her line South 67 poles to three chestnut oaks on the top of a hill near the road thence N 85 W 72 poles to a lynn & two beeches to HILLIS survey and with his line S 16 W 129 poles to a poplar & black walnut thence S 79 W 20 poles to an elm & black walnut thence N 37 W 22 poles to a hickory & two blue ashes thence N 81 W 17 poles to two white oak & hickory thence N 28 E 51 poles to a buckeye corner to RICH’D MILTONS 85 acre Survey & with his line N 20 W 105 poles to his corner & corner to lot No. 3 N 36 W 82 to the Beginning. To have & to hold the aforesaid tract or parcel of land with all & Singular the buildings & appurtenances unto the said JAMES T. WILLIAMS his heirs & assigns forever and the Said CHARLES G. CARTER & SALLY CARTER his wife for themselves their heirs and assigns unto the said WILLIAMS his heirs or assigns against the Claim or claims of all & every person or persons whatsoever the aforesaid tract or parcel of Land doth & will forever warrant & defend by these presents. In testimony whereof the Said CHARLES G. CARTER & SALLY CARTER his wife have hereunto Set their hands & Seals the day & date first above written. CHARLES G. CARTER, SALLY CARTER State of Indiana, Warrick County Sct. I JOHN B. KELLY probate Judge of Said County in Said State of Indiana do Certify that the foregoing deed from CHARLES G. CARTER & SALLY CARTER his wife to JAMES T. WILLIAMS was this day produced to me by Said Grantors and acknowledged and acknowledged by Said CHARLES G. CARTER to be his act and deed for the purposes therein named and the Said SALLY CARTER being examined by me privately and apart from her husband declared that She did freely and willingly Sign Seal and deliver Said writing and relinquished her right of inheritance in and to the land hereby conveyed and wished not to retract the Same and acknowledged the Said writing again Shown and explained to her to be her act and deed and consenteth that the Same may be recorded – Whereupon the Said deed together with this my Official certificate endorsed thereon is certified to the Clerk of the County Court of Cumberland County Kentucky (where the land lies for record. WILLIAMS was acknowledged and whose named is Signed to the foregoing certificate of Said Acknowledgement is and was at the time of taking and Certifying the same Sole and acting Judge of the probate Judge of the probate Court of which I am Clerk and his Signature to such certificate of acknowledgment is genuine and that full faith are due to his official acts.
