CHILTON This Indenture made and entered into this 18th day of September 1848 between SAMUEL A. CARTER & MARTHA his wife, CHARLES G. CARTER & SALLY his wife, CYRUS K. ALLEN & MARTHA JANE his wife, JEHU H. STONE & AMANDA S/L. his wife & JOSEPH A/S. CARTER (the said) SAMUEL A. CARTER, CHARLES G. CARTER, MARTHA JANE ALLEN, AMANDA S. STONE & JOS A. CARTER, JOHN ESKEN & MARY his wife state MARY CARTER being children and heirs at Law of WILLIAM CARTER Dec'd of the first part and WILLIAM W. CHILTON of the second part all of the County of Cumberland and State of Kentucky. Witnesseth. That the parties of the fist part have this day for and in consideration of the sum of Two hundred and fifty dollars to them in hand paid the receipt whereof is hereby acknowledged Sold bargained aliened transferred and conveyed unto the party of the second part all the right title interest Claim and demand which they and each of them have in and to the following described tract or parcels of Land being the five eights or five undivided Shares of the Said land, The first tract Containing Thirty four acres lying and being in the County of Cumberland on the north side of Cumberland river on the water of Rays branch and Ogden branch of Cumberland River and which said Thirty four acres of Land was patented to WILLIAM CARTER afsd of MILTON KING by patent bearing date the 24th day of June 1831 for a more particular discussion of Said Survey reference is here made to Said Pattent. The Second tract Containing 164 acres in all the five eights or five undivided Shares of Which except a g__ this day Conveyed to J. H. STONE by five of the heirs of WILLIAM CARTER Decd is hereby conveyed to Said pary of the Second part the said Survey of 164 acres is bounded as follows. Beginning on a beech in THOMAS CLOYDs line near his most northerly corner thence running with said CLOYD's line S 40 W 133 poles to two ash trees thence S 50 E 20 poles to WM RAYS two corner ash trees thence with his line S 55 W 172 poles to Said RAYS corner hickory and pointers in a military line with Said line N 48 W 6 poles, DEAKS three corner beeches thence with Said DEAKS line N 36 E 168 poles to a gum thence with another line of Said DEAKS N 53 W 40 poles to a buckeye Coffee tree and blue ash N 18 E 150 poles to a large poplar on a hill Side thence S 71 E 104 poles to two ashes and hickory in THOMAS BARTONS line with Said BARTONs line S 12 E 46 poles to the beginning the gore? above mentioned lying and being South west of two corners WM RAYs most Northerly corner and THOMAS CARTER'S most Eastward Corner bound on the north west by Said CARTERS Survey and on the South East by two Survey's of land where JEHU H. STONE now lives running up to an agreed line made between Said JEHU H. STONE and the Said W. W. CHILTON the land hereby intended to be conveyed to the Said CHILTON being the five eights or five undivided heirs of the 164 acre being except the gore or Slip of land belonging to Said STONE above mentioned and the five eights of five undivided Shares of the 24 acre Survey. To have and to hold our interests in the aforesaid tracts or parcels of land to him the said CHILTON and his heirs forever and the parties of the fist part Covenant and agrees to and with the Said CHILTON and his heirs forever that they will warrant and forever defend the right and title to the interests in the land hereby conveyed that is to Say to five Shares of the land before described each for himself respectively free from the claim of any and all persons whatever. CARTER and on the 2nd day of December 1848 acknowledge by CYRUS K. ALLEN and MARTHA JANE his wife on the 20th of October 1848 acknowledged by MARTHA CARTER on the 22nd of Dec 1848 acknowledged by AMANDA L. STONE & on the 16 of October 1849 acknowledged by JNO ESKIN & wife & SALLY CARTER & I examined the said __ __ apart from husbands respectively & they each acknowledged that they freely relinquished their rights of Dower & inheritance in & to the land hereby Conveyed of their own free will and accord & that they did not desire to retract the same & agreed that this deed should be recorded which I copied in deed book L, page 506.
