Witnesseth tha the said Thomas Thurmon for and in consideration of the sum of one dollar current money in hand paid the receipt whereof the said Thomas doth hereby acknowledge and also for an in consideration of the sum of one dollar to be paid by the said John to the said Thomas annually. The said Thomas hath leased and conveyed to the said John Thurmon all that tract or parcel of land with the improvements and appurtenances there unto belonging and lying a part of a tract of land of 3000 acres which the said John this day conveyed to the said Thomas in the County aforesaid which in contained within the following bounds towit: Beginning at the ferry landing opposite Burkesville commonly called and known by the name of Thurmon’s ferry thence with the present leading road to the ford of Cedar Creek thence up the same binding therein to the line of the said tract of land then with the bounds of the land to Cumberland River. Then down the same to the beginning all the land with the improvements and appurtenances heretofore ascribed. The said Thomas leases to the said John for and during the natural life of him the said John also for and during the natural life of Judith Thurmon wife of the said John Thurmon at the end or termination of which precedes the aforesaid land improvements are and shall revert to the said Thomas Thurmon and the said Thomas Thurmon doth covenant and agree with the aforesaid John that the said Thomas shall not at any period during the life of the said John and Judith cause to be established a ferry or any part of Cumberland River in the south on either the aforesaid land leased or on the lands heretofore sold the said Thomas adjoining the lands leased and the said Thomas doth further covenant with the said John that he the said John is to have the use, privilege and full profits of the ferry now established in the name of the said John on Cumberland River heretofore described for and during the aforesaid time and period of the lives of the said John and Judith provided tha the said John shall at his own proper costs and charges keep a boat or boats with a ferryman or men with all necessary materials and ______ as may by law be required of him and also that the said Thomas with all his property is to pass and repass ferry fee for and during the term aforesaid. King the clerk of the court for the County aforesaid do hereby certify that the within named Thomas Thurmon a party to the within deed of lease from himself to John Thurmon came personally before me in my said office on the 15th day of Janauary 1811 and acknowledged the same to tie his act and deed.
