Know all men by these presents that I Lively C. Johnston of the County and State aforesaid have this day given, granted, bargained sold and delivered unto William Thurman and Andrew Thurman of the same place one brown horse, one sorrel mare, two cows and calves and two feather beds and their ordinary clothing for and in consideration of the said William and Andrew Thurman having this day entered into an appeal bond with the said Johnson in an appeal taken by said Johnston against William Cain from the judgment of John M Emerson esq. On the 10th day of January 1826 for $42.00 in the clerks office of the Cumberland Circuit Court rendering yes for this condition that if the said Johnston shall and do well and timely pay and satisfy all of the aforesaid judgment with all interest and costs that may accrue thereon in case the said Johnson is case and made convict in said appeal then the said property is to revert unto the said Johnston to be his own, otherwise said William and Andrew are to retain the ownership and possession of the same until said debt or judgment as aforesaid is paid. In witness whereof the said Johnston hath hereunto set his hand and seal this 11th day of January 1826. Witness signed: Lively C. Johnston (seal) Edwards King Kentucky Cumberland Co I, Milton King, Clerk of the County Court for the County aforesaid do certify that Lively C. Johnston the mortgagor to the within mortgage to Andrew and William Thurman came before me in person in my office on the 11th instant and acknowledged the same to be his act and deed and I have truly recorded the same together with this certificate in my said office in deed book F page 30.
