King, clerk, for bond, oath, certificate on bond, order of probate, order to appraise part of Estate, being four slaves, designated in the last will and testament of the above deceased for and to administer , together with other papers and records which may be seen in the said clerk's fee bill, which amounts to $2.97 Nov. - To appraisers .62 1/2 Taking care of one of the above named slaves 2 weeks in child bed 4.50 $7.59 1/2 I, John E. King, the Clerk of the Court in and for the County aforesaid do certify that the within account of John S. Gee, Executor in part of and against the Estate of Jesse Gee, deceased, was produced in Court, examined, approved of and ordered to be recorded and that I have recorded the same together with this certificate in my said office in Will Book B, page 25. King ======================================================================= Will Book B, page 256 Jesse Gee, Deceased Sept. 9, 1824 We, Moses Kirkpatrick, William Biggerstaff and Varney Andrews, in pursuance to an order of the Cumberland County Court, August term, 1823 being sworn as the law directs, proceeded to settle with John S. Gee, one of the executors of the estate of Jesse Gee, deceased, and we find by vouchers exhibited by said executor that he has paid all the legatees their portions in full of said estate, which he was bound to pay, as designated in the will of the aforesaid deceased. Gee by Guardian, Complainant, against The Heirs of Jesse Gee, deceased, Defendants In Chancery This day came the complainant aforesaid and by her counsel and on her motion, it is ordered that Samuel Wilborn(?), William Biggerstaff and Moses Kirkpatrick or any two of them, be and are hereby appointed commissioners to ascertain the quantity and value of each tract of land mentioned in the last Will and Testament of the said Jesse Gee, deceased, and report thereof plainly and distinctly to the first day of the next June term of this Court and cause continued until the next Term. Ordered that the Court be adjourned until Court in Course. Gee, Complainant, against Gee Heirs, Defendants--In chancery On the motion of the Complainant aforesaid by her attorney, it is ordered that the Order of Continuance made in this Cause on a former day of this Term be set aside. ======================================================================= Civil Order Book D, page 367 Wednesday, the 23rd day of October, 1822 Amanda L. Gee by Guardian, Complainant) Against Robt. Pottinger and others, Defts. ) In Chancery This day came the Complainant by her counsel and made satisfactory proof to the Court that the order to advertise in this Cause made at the last July term had been inserted in an authorized newspaper printed in this State for 2 successive months and the Cause is continued until next Court. ======================================================================= Civil Order Book D, page 450 Monday, the 21st day of April, 1823 Amanda L. Gee by her Guardian, Complainant) against the Heirs and legatees of Jesse Gee, Dec.) In Chancery This day this cause came on to be heard on the bills, answers, and exhibits, on consideration whereof it appears to the Court that all the personal Estate of the Testator, Jesse Gee (other than slaves) which came to the hands of the Defendant, Wm. Anna Enyart, under the will of her late husband for the benefit of herself and her son Jesse Gee, was of the value of $1,730.30 1/2 of two thirds. Whereof the Complainant is legally entitled to demand one tenth part, it further appears to the Court that, exclusively of Peter and Molly devised of the defendant Wm. Anna during her life, all the slaves of the deceased, distributed among the other legatees under the will aforesaid were of the value of $2,704.00. Whereof the Complainant is legally entitled to one tenth part. It is therefore decreed and ordered that the defendants Abraham Enyart and Wm. Anna, his wife pay to the Complainant out of the Personal Estate aforesaid, the sum of eighty two dollars and eight cents, being the tenth part of the value of two thirds of the Personal Estate aforesaid, with interest after the rate of six percentum per annum from the 18th November, 1815 until paid. And it is further decreed and ordered that the complainant recover against the other nine defendants and legatees the sum of $270.40, being the tenth part of the value of the negroes divided among them, under the will aforesaid, with legal interest thereon from the 16th November, 1814, which said sum is to be paid to the Complainant by the nine legatees aforesaid in proportion to their several legacies, viz: John S. Gee is to pay $101.30; Jesse Gee, $20.00; and the other seven defendants Robert Pottinger and Fanny his wife; Thomas Linkhorn and Patsey his wife; E. Kirkpatrick and Betsey his wife; John Smith and Sally his wife; John Autry and Polly his wife; John Trueax and Lucy his wife; and Winney Tudder $21.30 each- with interest as aforesaid on each sum respectively. It is further decreed and ordered that the Complainant recover of the Defendants one equal undivided tenth part of the three tracts of land in the will mentioned, and that she have and enjoy the same to her and her heirs forever, reserving however to the defendant Wm. Anna her right of dower therein, and it is further finally decreed and ordered that the defendants John S. Gee and Jesse Gee or such of the defendants as may under the will aforesaid have a right to the slaves Peter and Molly after the death of the defendant Wm. Anna, shall pay to Complainant when the said slaves shall come to him, her or their possession one tenth part of the then value of said slaves, to be paid by said legatees in proportion to the value of their respective interests in said slaves under the will aforesaid. This decree is not to prejudice the claim of the claim of the defendant Wm. Anna for remuneration for the support and maintenance of the Complainant Amanda, but if she has any claims it is hereby expressly reserved to her. It is ordered that the costs of this suit be paid in equal proportions, by the Complainant and each of the Defendants. Ordered that Court be adjourned till tomorrow morning _____ of the clock.
