Will Book D, page 337-8, dated 4/22/1840, probated 5/22/1845 Contributed for use in USGenWeb Archives by: Zandra Pearson - zpearson@juno.com John GARMAN, Sr. Dec'd In the name of God Amen, I John GARMAN, Sen. of the County of Cumberland and State of Kentucky do hereby make my last Will and Testament in manner and following, that is to say: First, I desire that all my just debts be paid out of my estate should there be any against me at my death. Secondly, I give to my wife Ann GARMAN, all my estate both real and personal to use as she may think proper for her own use and benefit until my youngest son Henderson shall arrive at the age of twenty one years (that is to say all my property not given away in other legacies in following part of the will). Thirdly, it is my will and desire that at the death of my wife should she remain a widow, my lands whereon I now live be equally divided in quantity and quality between my three sons (to wit: Leonard, Rhodes and Henderson)should my wife think proper at any time during her life or widowhood she can have a division of the land & other property agreeable to the provisions of this will her three sons to wit: Leonard, Rhodes & Henderson binding themselves to give her a decent support during her natural life of widowhood and to pay to there (sic) youngest sister Malinda GARMAN, the sum of two hundred dollars in money where she may arrive at the age of twenty one years. ____ Fourthly, where my youngest son Henderson shall arrive at the age of twenty one years it is my will that my wife Ann GARMAN take any part of my personal property that she may think fit for her use and benefit during her life or widowhood and divide the balance among the youngest children that have not received anything by way of advancement so as to make them equal in proportion with those who have heretofore received property by way of advancement or other wise. Fifthly, I give to my seven oldest children namely (to wit): David GARMAN, Nancy ROWE? John GARMAN, Jacob GARMAN, Isaac GARMAN, Elizabeth NORRIS and Sally GARMAN, each of the sum of two hundred dollars in money, to be paid at the expiration of four years from the time of my decease __ and the interest accruing on my money or notes, I give to my wife Ann GARMAN for four years after my decease to use of as she may think fit and co_______ (illegible). Sixthly, I give to my three youngest sons, Leonard, Rodes (sic), and Henderson one hundred dollars in money each, and my waggon & gear Black Smith's tools &c. to the use of my wife and the farm during her life and at her death the waggon & smiths to revert back to my estate for an equal distribution with this property. Seventhly, It is my wish that my wife give to my four youngest children any such property and at such time as she may think fit, or that they may need such as saddles, bridles, clothing, &c. Eighthly, It is my will and desire that at the death of my wife Ann GARMAN all my estate not heretofore given away in this will be equally divided among all my children so as to make them all as nearly equal as the nature will admit of. Ninthly, I do constitute and appoint my wife Ann GARMAN & my sons Leonard & Rodes GARMAN my executors of this my last will and testament hereby revoking all other and former wills by me made.
