Will Record A-b Written: December 9, 1847 Kentucky, Daviess Co. will record A-B Will of George Kelly In the name of God Amen. I,George T. Kelly, of Daviess county, Kentucky, being afflicted in body, but of sound mind & memory do Herby constitute this my last will and testament revoking all others heretofore made by me. Imprimis- - I give my soul to Almighty God who gave it to me. Secondly - I will and disire that all my just debts be paid & settled Thirdly - I hereby confirm and ratify the gift heretofore made to Daniel Murphy and my daughter Harriett, their heirs of Negroe boy Jim together with a horse and bed. Fourthly - I here by confirm and ratify the gift heretofore made by me to William Protsman and Polly, his wife, of Negro girl Frances, together with a horse bed and furniture and cow and calf. Fifthly - I hereby confirm and ratify the gift made to my daughter , Mildred Leaman of Negro girl, Virginia & bed & furniture. Sixthly - I hereby ratify and confirm the gift heretofore made to my daughter, Ruth Anderson, of Negroe girl Lucinda, bed and bedstead and cow. Seventhly - I herby confirm & ratify the gift heretofore made by me to my daughter Jemima Hudson of Negro girl, Rachel, Bed & furniture. Eightly- I hereby ratify and confirm the gift heretofore made me of a Negro boy Keak and a horse and cow to my son Thomas. Ninethly- I hearby confirm & ratify the gift heretofore made to my daughter Agnes Barnes, wife of James Barnes of Negro girl Meary and bed and furniture. Tenthly - I hereby devise & bequeath to my wife Jane Kelly in trust for the use & benefit of my son George Kelly, Negroe boy Jack with a bed and furniture at her death or sooner if she deems it prudent. She is to make and absolute letter or bill of sale to said slave to the said George Kelly or she may make a deed of trust at her death to some other person of said slave for the use & benefit of the hire of said boy. Jack annually and the legal title passes to him as soon as my wife can do it in safety so as not to make said Negroe boy liable to be taken to pay security and other old debts now hanging over my said son George Kelly. Eleventhly-I hereby give and bequeath to my son Talbott Kelly Negroe boy Scott like delivered to him when my debts are paid by his other only other Negroes here, but upon the condition that he shall pay my son Barnett Kelly one hundred dollars in cash. Twelfthly-I hereby direct my Negroes Scott, Henry, Winny and Meary be hired out by executrix & executor herein after named for two years and longer if necessary and proceeds applied to pay all may just debts. Thirteenth - I hearby bequeath to my son Barnett Kelly Negro girl Winny like delivered to him after my debts are paid by the hire of my Negroes and $100 in cash to be paid him as herein directed by his brother Talbott Kelly. Fourteenth-I give to my daughter Elizabeth Bozarth Negro girl Tony to be delivered to her at my wife's death. I hearby bequeath to my beloved wife & companion Jane Kelly for and during her life the plantation where on I live and all my personal estate absolutely and I also give to my said wife for life the following slaves, Mary, Polly & Tony. The two first Mary and Polly to be her absolute property of my said wife, and Tony at her death belonging to my said daughter, Elizabeth Bozarth. I hearby devise that my said Negro boy Henry be sold when my debts are paid by the hire of Negroes and the proceeds to be divided out among each of my children as she may deem right and most entitled to the same. I hereby bequeth to my wife and my son Talbott Kelly who appoint Executrix and Executor of this will full power to sell the plantation before my wife's death if she wishes and impair to them full power and authority to make a conveyance for said land, the proceeds of the sale of said land whenever made. It is to be divided equally among my legal heirs and if the said land is not sold during my wife's lifetime, I hereby direct my said Executor Talbott Kelly to sell & convey the same at my wife's death in 12 months. Credit and divide the proceeds among my legal heirs & representatives. In testimony where of the said George I Kelly signs and seals and acknowledges and subscribes this writing as his last will and testament. December 9, 1847 George T.
