First it is my will that my family live out the present year on the farm I now live on and within one year from this time it is my will that all my estate real and personal shall be sold and converted to money and the proceeds to be held and used by my beloved wife Hariet for the maintenance and education of herself and our infant children during her widowhood, but if she marries then funds to be placed in the hands of a guardian for the purposes above mentioned and at her death to be equally divided between my children. It is my will that my Negro man James shall be free after the death of my wife and myself. I appoint my wife Harriet and Daniel M. Griffith my Executors of this my last will and testament. Additional Comments: History of Daviess County states that a T. Burgess shot a D. Murphy, the latter having died four days later, in October of 1854. Daniel's will was probated in court November 1854. A search of the 1850 census shows that Daniel Murphy was the only Murphy living in the area with the first initial being D. Daniel's will was said to have been hastily written, which could explain why he doesn't name any of his children.
