WILL: Elvira Duke, 1876 - Edmonson County Contributed for use in USGENWEB Archives by: Sue Kirves Date: Mon, 05 Jun 2000 15:21:16 -0400 (Pages 15-17, Will Book No. 2, Edmonson County, Kentucky, Courthouse) Elvira Duke Last Will and Testament I, Elvira Duke, of Edmondson County, State of Kentucky, being of sound mind and disposing memory do make and publish this my last Will and Testament. 1st It is my will and desire that the land or parcel of land that was set apart to me as my dower interest in the lands of my husband Thomas T. Duke, deceased, be equally divided between my son Samuel S. Duke, my daughter Anne E. Freeman, and my sister Annetta Gatewood; and I also will that the lands on the knobs, which was purchased of W. H. Cooke being ninety-nine acres be equally divided between my son Samuel S. Duke, my daughter Anne E. Freeman, and my sister Annatta Gatewood. 2nd It is is my will and desire that the lands that I purchased of William T. Duke, it being the same that was set apart to him as his interest in his father, Thomas T. Duke lands, be sold and the proceeds of same or so much thereof as may be necessary be appropriated to the payment of my debts. Should there be any proceeds of said sale left, I desire that it be equally divided between my son Samuel S. Duke and my daughter Anne E. Freeman. 3rd It is my will and desire that my son Samuel S. Duke have my interest in the tract or parcel of land on which I now reside and which was purchased of Meredith Cox. 4th It is my will and desire that my son Samuel S. Duke have the proceeds and control of all my lands during my natural life and should I die in any year after there has been preparation made for a crop, or a crop has been planted or raised, it is my will that my son Samuel S. Duke, have the sole interest of such crop. And last I hereby appoint my son Samuel S. Duke and my son-in-law A. E. Freeman, Executors of this my last Will and Testament. Meradith Cox State of Kentucky Edmondson County I, Noah Morris, Clerk of the County Court in and for said county, do certify that on the 4th day of December, 1876, at a regular term of the Edmondson County Court, the foregoing instrument of writing purporting to be the last will and testament of Elvira Duke, Dec’d., was filed in open court and offered for probate, wherefore the same was duly proven to be the Last Will and Testament of said Elvira Duke, by the oath of N. G. Gossam and Meredith Cox, the two subscribing witnesses thereto and the same was approved by the court and ordered to be entered of record, whereupon the same together with this certificate has been duely admitted to record in my office. Given under my hand this 30th day of December 1876.
