Elliott County Court
IN THE MATTER OF THE ESTATE OF J.P. FRALEY, Deceased

ORDER
	This day came Milt Fraley and filed his application for probate of the destroyed Will of 
J. P. Fraley, and it appearing to the Court that J. P. Fraley owned certain land located in the 
county of Elliott, State of Kentucky, and it appearing from the oral testimony of Milt Fraley, 
Ransom Fraley and J. T. Salyers that the Last Will and Testament of J.P. Fraley was probated and 
filed for record in the Elliott County Clerk’s Office on or about June 7, 1937, and that said 
Will was made and published in proper form and order, in accordance with the provisions of the 
laws of the State of Kentucky, as made and provided and applicable thereto, and that it 
contained the following provisions.
	1.  To Milt Fraley, my home farm known as Perry Rose Farm being the same property 
obtained by J.P. Fraley from J. W. Greene, Executor of the Estate of J.P. Rose, said deed 
recorded in Deed Book 21, page 356, Elliott County Clerk’s Office.
	2.  To Ransom Fraley my part of the D. A. Fraley farm on Anderson Ison Branch of 
Newcombe Creek.
	3.  My wife, Ginia Lee Fraley, all the money I may have left after debts be baid and 
what money be left at death of my wife be divided equally between my daughters, Bethel, Fannie, 
Alvia, Eulah and Hazel.
	4.  The oil rights on farm I sold Albert Boggs known as Andy Pennington farm I give the 
right to Milt Fraley to lease and the proceeds of rental to be paid to my wife, Ginia Lee 
Fraley, at her death the rental to be paid to Milt Fraley.  If oil is developed the proceeds to 
be divided equally among all my children, Milt, Ransom, Taylor, Bethel, Hazel, Fannie, Alva and 
Eulah.
	5.  To Taylor Fraley $500.00 to be paid by Milt Fraley when all other conditions of this 
Will are fulfilled.
	6.  Milt Fraley to be appointed Administrator without bond.
	It is ordered and decreed that the destroyed Will of J. P. Fraley, as described in the 
application for probate, be probated and a copy of this Order be recorded upon the record of 
Wills.
	This 29th day of March, 1958.

	I, Estill Hutchinson, County Court Clerk in and for the County and State aforesaid, 
certify that the foregoing writing having been presented to the Elliott County Court as a copy 
of the Last Will and Testament of J. P. Fraley and the Court having examined same and hearing 
evidence the same was admitted to probate and ordered recorded upon the records of Wills of the 
Court.
	Given under my hand, this 9th day of April, 1958.
