Boone, a notary public at the court house in Lebanon, pursuant to the enclosed notice, to be read as evidence in a case pending before the Estill Circuit Court, Estill County, Kentucky between James Townsend and Susan, his wife, John Robertson, Ozias Robertson, Joseph Swope and Julia Ann, His wife, John Parke and Melinda Parke his wife, Ebenezer Swope and Lucinda Swope, his wife, and Malinda Jane Robertson, James F. Robertson and William O. Robertson, Julia Ann Robertson, John F. Robertson, Jesse B. Robertson, Susan Robertson, Francis M. Robertson and Robert W. Robertson. Plaintiffs and John J. Wells, et al, defendants. The said John Howard being duly sworn says that he is well acquainted with the above named plaintiffs, and the said Robertsons are the descendants of Jesse Robertson, deceased. Julia Ann Swope, wife of Joseph Swope, Malinda Parke, wife of John Parke, and Lucinda Swope, wife of Ebenezer Swope are the daughters of the said Jesse Robertson, deceased, that they are so known, respected and accredited, and have been for some years past during the acquaintance of this deponent with the said persons. That Malinda Jane Robertson, John F. Robertson, William O. Robertson, Jesse B. Robertson, Susan Robertson, Francis M. Robertson, George N. Robertson, Nary Ellen Robertson and Robert W. Robertson are the sons and daughters of William Robertson, late of Boone County, Indiana, deceased, that the said William was the son of Jesse Robertson; that he was well acquainted with the said William in his lifetime and the said sons and daughters above specified since that time; that said Jesse Robertson died in Boone County, Indiana; that this deponent is not of kin to any of the persons herein named nor has any interest whatsoever in making this deposition. signed John Howard. Powell said that he is acquainted with the sons and daughters of Jesse Robertson, deceased, that he is also acquainted with the said Malinda Jane, James F., William O., Julia Ann., John F., Jesse B., Susan., Francis N., George W., Mary Ellen, and Robert W. Robertson, and that they are the sons and daughters of William Robertson, late of Boone County, Indiana, deceased, that the said Jesse died in this county (Boone) sometime in the year 1846, and the said William died in this county sometime in the year 1848; and John F., one of the sons of the said William was drowned in the canal on the Wabash River.
