Swart Farm, Fleming County, Ky, 15 March 1905 Jennie L. Dayton & als. To-Deed James Bishop This Indenture, Made this 15th day of March, 1905, Between Jennie L. Dayton and E. Dayton, her husband of Portsmouth, Ohio, and Nannie E. Dayton and T.W. Dayton her husband of the County of Fleming, State of Kentucky, parties of the first part, and James Bishop of the County of Fleming, State of Kentucky, party of the second part-Witnesseth-That in consideration of ($3540.07), Three Thousand five hundred and forty dollars and seven cents, paid cash in hand, the receipt of which is hereby acknowledged. The parties of the first part do hereby sell and convey unto the party of the second part, his heirs and assigns forever, the following described real property, to-wit:- A part of a certain tract of land in Fleming County Kentucky, known as the Henry T. Swarts farm, lying on Johnson Creek and both sides of the Maysville and Lexington Turnpike road and bounded as follows: Beginning at a set stone upon the East side of the above named Pike upon a bank where an oak once stood at the north corner of a rock quarry at fig. 26, on the plat of same land, corner to lot No. 2 in the division among the heirs of Daniel Clarke dec'd. Thence with a line of same N. 30 E 12 ½ poles to a set stone upon the East margin of said pike. Thence E. 77 ½ poles to a Slippery Elm and Black Hawk corner to John and Sarah Graves, thence with line of same N 21 poles and 20 1/3 links to a stone on the East margin of the pike, thence up the pike S. 66 ¾ W. 3 chs. & 7 links to a stone on East margin of the pike, thence N. 73 W. 9.64 chs. to a point in center of the pike, thence N. 54 w. 2.27 chs. To a stone on the west margin of the pike. Thence S.48 W. 3.58 chs. To a point in the center of the pike, thence S.83 ½ W. 2.88 chs. To a stone on the west margin of the pike near the mouth of a culvert, thence leaving the pike through the orchard N. 27 ¾ e 3/09 chs. To a stone in the orchard. Thence N. 87 W. 13. 26 chs. To a stone on the East an upper side of a road, leading down to Johnson Creek. Thence along on the upper bank of said road, toward the creek N. 5 ½ E 2.46 chs. To stone in the turn of the road. Thence N.4 W. 5.50 chs. To a black oak stump, thence N.19 ¼ W. 7.15 chs. To a standing blk locust post in the branch. Thence N.10 W.5.44 chs. Crossing a small branch in the bottom land to a point in the center of Johnson Creek, on the South of the crossing opposite a small Hackberry bush on the west side of the creek on Toller's land, thence down the creek in the center thereof and with its meanders N.82 ½ W. 124 1/3 poles S. 70 ¾ W. 24 poles, S. 74 ¼ W. 18 poles S. 56 W. 26 poles, N. 74 W. 12 ½ poles N.% W.50 poles N.10 ½ E. 21 poles N. 2 ¾ W. 33 2/10 poles N. 38 W.1 ¾ poles. Thence leaving the creek W.28 ¼ poles to a set stone on the hill in Stout's line, thence with same S. and continuing Stouts line in all 165 4/10 poles to a stake upon the hill side a corner to Stout, thence with another of his lines N. 88 ¼ e. 105 ½ poles to a large poplar stump corner to Stout, thence with his line S.34 E.62 ½ poles to a set stone upon the North west side of the turnpike corner to same, thence N.46 ½ E. 18 6/10 poles to the beginning. Containing according to the old survey, 84 acres, 1 rood and 6 poles, more or less. Being a part of the same land conveyed by H.C. Hawkins and wife to Jennie L. Layton (sic) and Nannie E. Layton (sic) March the 15th 1900 and recorded in Deed Book NO. 66 Page 403 in Fleming County Court Clerks Office. To have and to hold said property unto the part of the second part, his heirs and assigns forever. And said parties of the first part hereby release all their right title and interest in said property including the homestead Exemption allowed by law and covenant unto the party of the first part, his heirs and assigns forever. Dill Marvin C. Clark State of Ohio-Scioto County-ss. On this 20th day of March A.D. 1905, before me a Notary Public in and for said County, personally came Jennie L. Dayton and Ethelbert Dayton, her husband, the grantors in the foregoing deed, and acknowledged the signing thereof to be their voluntary act and deed. Hawkins, Notary Public in and for said County and State, do certify that the foregoing instrument of writing from Nannie E. Dayton and T.W. Dayton, her husband to James Bishop, was this day presented to me by the parties in said County and State and acknowledged by said Nannie E. Dayton and T.W. Dayton, her husband to be their act and deed for the purpose therein contained. This deed together with this certificate is hereby certified to the proper office for record.
