Book M page 548 I Miles Hurst Jr. of the County of Fleming and State of Kentucky being sound in mind but frail in body and being fully persuaded of the uncertainty of life and certainty of Death have concluded to dispose of my Estate both real and personaly as best suits me. I therefore make and publish this my last Will and Testament Revoking all other Wills heretofore made by me-First- After my demise I will that all my just debts if any be paid Second I will that through the affection that I have for my Wife Ann Eliza Hurst I give to my said wife Ann Eliza all of my entire estate of Every description both Real and Personal to have and to hold during her life or so long as she Remains my Widow and to hold and have the Entire Control and use of the same on Condition that my said Qnn Eliza is to furnish Each of the children as they become Twenty one uears of age a Good Horse Bridle and saddle out of the personal Estate that I leave on hand Furthermore if my Wife Ann Eliza should again marry then my personal Estate that is on hand is to be Equally divided amongst my children To Wit Charlotte, David Webster and Mary Simpson also if there should be any other Issue of my Body they share equally with the above named Children also if my said Wife should again Marry my Real Estate that I possess shall be Equally Divided between my above named children Furthermore if my Wife Ann Eiza should remain my Widow during all her Natural Life then at her Death all my entire Estate both real and personal is to be divided between my Children heretofore named and in the same Manner above described In Witness Whereof I have hereunto set my hand this 15th day of January 1866 Attest Miles Hurst Junior William Carpenter N.F. Hurst Fleming County Sct At a Court held for Fleming County on the 23rd day of April 1866 This writing purporting to be the last Will and Testament of Miles Hurst Dec'd was producec in Court and proven by the oath of Nelson F. Hurst a subscribing witness thereto said Nelson F. Dobyns Clerk of the Fleming Court do hereby certify that the written Paper was by a Judgement of the Fleming Circuit Court rendered on the 17th day of August 1870 adjudged to be the last Will and Teatament of Miles Hurst deceased and the same was ordered to be certified to the clerk of the Fleming County Court there to be recorded as the last will and Testament of said Miles Hurst dec'd from this date which is done accordingly Witness my Signature as clerk of said Court this the 17th day of August 1870 H.B.
