Will of James B. McDowell - Fulton County Will Book 1, pg.564 Known all men by these presents: That I James Bosbyshell McDowell, of Fulton, County of Fulton and State of Kentucky, a merchant, being of sound mind and memory but knowing the uncertainty of this life do make this my last will and testament. After the payment of my just debts and funeral expenses, I bequeath and devise as follows: FIRST, I do give and bequeath to my wife, Mary Annie McDowell my house and Lots on State Line Street, Fulton, Kentucky adjoining to the First Methodist Church, known as my home place, also a house and lot on Washington Avenue in G.W.Paschall's addition to the city of Fulton, Kentucky, beginning at Moores north west corner, which is forty feet north of the alley on Moores south line, and thence north on Washington Avenue forty feet, thence east sixty five feet, thence south forty feet to Moores line thence west sixty five feet to the beginning, also lots #16, 17, 18, 19, 20, 21 in block 9 in Collins addition to Islanda, New Mexico to have and to hold same during her natural life time or till she marries. SECOND, At the death of my wife Mary Annie McDowell or when she marries, all That I will to her shall be given to and possessed by my daughter Mary Elizabeth Myrick to have and to hold same during her natural life time or till she marries. THIRD, At the death of my daughter Mary Elizabeth Myrick or when she marries, All that I will to her shall be given to and possessed by my grand daughter Hallie Myrick to have and to hold same forever. FOURTH, I further direct that my son Melville Percy McDowell shall manage and control said property for my wife and for my daughter Mary and at the death of my daughter Mary, my said son shall be appointed guardian with out bond for my grand daughter, Hallie Myrick. FIFTH, I give and bequeath to my daughter Fannie McDowell Strang, Twenty five dollars, in cash. SIXTH, I give and bequeath to my garnd daughter, Anita Hunter Bell, Ten dollars, in cash. SEVENTH, I give and Bequeath to my grand son James Percy Luttrell, Ten dollars, in cash, my reason for not dividing my property equally between my two daughters, is that my daughter Fannie is married and has means to support and my daughter Mary has herself and a child to support. EIGHTH, I give and bequeath to my son Melville Percy McDowell, all my Personal property with which I shall be seized or possessed at the time of my death, also, my interest and stock of merchandise, also lots in G.W.Paschall addition to the city of Fulton, Kentucky, beginning at a stake at the intersection of Washington Avenue and Main Street and thence east 65 feet to the city property, thence south seventy feet, thence west sixty five feet, thence north seventy feet to the beginning, also lot #5 in block #5 of the G.W.Paschall addition to the city of Fulton, conveyed to M.A.McDowell by R.A.Freeman, also lots #13, 14, 15 in block #9 in Collins addition to the city of Weatherford, Oklahoma; also Lots #4, 5, 6 in block U and Lot #12 in block K of the Amastsia Hotel and Improvement Co. survey on Crescent Beach, St. John's County, Florida, also lots #26 to #32 on North Topeka Avenue, Fords addition to the City of Wichita, Sedgwick County, Kansas and Lot #17 block #3 Washington Avenue of the City of Wichita, Sedgewick County, Kansas, also any other real estate not will to other parties, with which I shall be seized or possessed at the time of my death to have and to hold same during his natural life time. NINTH, I further give and bequeath and devise to my son Melville Percy McDowell full power to control, use and manage in any way he may see fit for his personal benefit, sell, deed and convey said property above described and willed to said son, and use proceeds of same for his own personal use as he may deem proper and deeds executed by my said son shall be valid with out any reference whatever to his wife Mary Lena McDowell and with out her consent and signature, this power will and gift is to my son Melville Percy McDowell personally and no part whatsoever to his wife Mary Lena McDowell. TENTH, at the death of my son, whatever of the above estate or the proceeds of or accumulation of said estate, or the proceeds of or accumulation of said estate is left, if there be any, and everything both real and personal with which my son Melville Percy McDowell shall be seized or possessed at the time of his death shall be equally divided between my two daughters Fannie McDowell Strange and Mary Elizabeth Myrick to have and to hold during their natural life time and at the death of my daughter Fannie her part shall be given to and possessed by my grand daughter Anita Hunter Bell to have and to hold and at the death of my daughter Mary her part shall be given to and possessed by my grand daughter Hallie Myrick to have and to hold same forever. ELEVENTH, I direct that my son Melville Percy McDowell be appointed executor Of this my will as trustee hereunder and I further direct and request that my said son be exempt from furnishing bond either as executor or as trustee hereunder. In Testimony whereof this 18th day of June in the year of our Lord Nineteen Hundred and Thirteen. On the 18th day of June 191 James Bosbyshell McDowell signed this instrument in Our presence declaring it to be his last will and as witness thereof we three do now at his request in his presence and in the presence of each other hereunto to subcribe our names.
