Gardner, John M. Gardner, Marshall B. Gardner, John Breeden, Sarah Jane Breeden, Theophilus Robison, Amanda Harriett Robison, Ephraim A. Gardner Saml H. Gardner, Fielding S. Gardner and William N. Gardner, heirs and legal representatives of Zacheriah Gardner decd by John T. Robinson Master in Chancery, Gallatin Circuit Court of the first part, and Mareen Briscoe of the same County and State aforesaid of the second part, Witnesseth: That whereas a decree was rendered by the Gallatin Circuit Court at the Sept. Term 1847 thereof in a certain suit in Chancery therein pending, wherein Z Gardner's will was ... and the said Z Gardner heirs and Creditors were defendants, directing the Master of said Court among other things to offer for sale the tract of land in Complts Bill described, or so much thereof as might be sufficient to satisfy and pay the creditors of said decedent the sum of (blank) and whereas afterwards to wit at the March Term 1848 of said Court, the Master aforesaid returned his report in substance that he had offered the land aforesaid, as directed and that Miley W. Shirley became the purchaser of 95 acres of said land at the sum of $348.20. That being the highest and best bid and whereas afterwards to wit at the September Term 1848, the Masters report was confirmed and the purchase money being paid into the hands of the Master, he was ordered and directed to convey said 95 acres of the land aforesaid to the purchaser M. W. Shirley as aforesaid And whereas the said Miley W. Shirley filed with the Master aforesaid a memo in writing, that he had sold said land purchased by him as aforesaid to Mareen Briscoe, and directed that the Master aforesaid convey directly to said Briscoe in his ... and stead: Now therefore, the said Margaret Gardner, Zachariah S. Gardner, John M. Gardner, Marshall B. Gardner, John Breeden, Sarah Jane Breeden, Theophilus Robison, Amanda Harriet Robison, Ephraim S. Gardner, Saml Gardner, Fielding Gardner and William N. Gardner heirs and legal representatives of Z. Gardner decd by John T. Robinson Master as aforesaid for and in consideration of the premises and for and in consideration of the sum of $.(blank) as aforesaid hath granted bargained and sold, and by these presents doth grant bargain sell and convey unto the said Mareen Briscoe all that certain tract or parcel of land situate lying and being in the County aforesaid on the waters of Lick Creek and bounded as follows to wit: Beginning at a stone in a drain corner to John Gardner thence S 68 o W 5 poles to a stone corner to ..., thence S 13 E 250 poles to a stone on Lick Creek, thence S 52 E 6 poles to an elm Buckeye and ironwood thence N 6 E 4 poles to a white oak and Hickory, thence N 10 W 99 poles to a white oak, thence N 6 E 53 poles to a stone in a drain, thence up the same with meanders N 7 W 55 3/4 poles N 24 E 38 poles to a sugar tree and beech. Thence S 470 W 135 poles to a stone in a drain thence up the same with meanders N 15 W 42 poles, N 5 ½ E 1 3/4 poles N 13 E 30 poles to the beginning containing 95 acres be the same more or less. To have and to hold the aforesaid described premises together with all and singular the right privilege and appurtenances thereunto belonging or in any wise appertaining unto him the said Mareen Briscoe his heirs and assigns forever. And the said Margaret Gardner, Zach S. Gardner, John M. Gardner, Marshall B. Gardner, John Breeden, Sarah Jane Breeden, Theophilus Robison and Amanda Harriett Robison, Ephraim A. Gardner, Saml H. Gardner, Fielding S. Gardner and William N. Gardner heirs and legal representatives of Z. Gardner decd by John T. Robinson Master as aforesaid for themselves their heirs do covenant and agree to and with the said Mareen Briscoe his heirs that they will warrant and defend the premises aforesaid free from the claim or demand of all and every person or persons so far as assetts of the said Z.
