All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ky/kyfiles.html ************************************************ File contributed for use in USGenWeb Archives by: Linda Deppner http://www.genrecords.net/emailregistry/vols/00012.html#0002870 March 15, 2014, 1:30 am Written: September 15, 1834 Recorded: September 20, 1834 Garrard County, Kentucky Deed Book L, page 322-323 No. 405 Jaley Hubbard to Henry Yater This Indenture made this 15th day of Sept in the year of Christ 1834 between Moses Hubbard Executor of John Hubbard dec'd and Jaley Hubbard of the County of Garrard and State of Kentucky of the one part and Henry Yater of the County and State aforesaid of the other part Witnesseth, that whereas John Hubbard dec'd late of Garrard County did on the 19th day of Dec 1826 made and publish his last will and testament which since the death of him the said John has been admitted to, and now is of record in the office of the Garrard County Court, and refered to, and by his said will of which he appointed afsd Moses Hubbard and Jaley Hubbard his Exors, the latter of whom however, has failed and refused to qualify as such, devised to the said Jaley Hubbard then his wife the tract of land on which he the said John lived in Garrard County during her natural life or state of widowhood, and empowered and licensed her to sell any part or the whole of said tract of land if she should think proper, and make a full and complete title to the same, Now this Indenture Witnesseth, that the said Moses Hubbard Exor of the last will and testament of John Hubbard dec'd and the said Jaley Hubbard for and in consideration of the sum of Five Hundred and Fifty Dollars, to the said Jaley in hand paid the receipt whereof is hereby acknowledged, have bargained and sold and by these presents do convey unto him the said Henry Yater, and unto his heirs and assigns forever, a certain tract or parcel of land, situated in the County and State afsd. on the waters of lick creek, a branch of Pt. Lick, being the residence and part of tract devised to Jaley Hubbard by Jno Hubbard dec'd as above mentioned and containing by survey, Ninety five acres, and is bounded as follows, Beginning at a beech tree, at the mouth of a drain corner to Jonce Finnell, near and just below a water [?] gap on the south bank of back lick creek, thence up with the meanders of said drain S15¼W 28 poles, to Schoolers line, thence S82°W 38 poles, to an ash and horn beam, in the head of the pawpaw hollow, thence N35°W 63 poles, to a beech on a hill side on Yater's line, thence N77°E 9¼ poles to a young hickory corner to Yater, thence his line, W27½W 68 poles to a hickory on Hugh Logans line, thence with his line N6¼°E 19 poles to a stake or stone, on the point of a ridge, corner to Logan, thence N87½W 58½ poles to a stake in James Finnell's line, thence with the same S54°E 106 poles to a stake in James Finnell's pasture on the side of a hill corner to James Finnell afsd. thence his line S2°W 80 poles, to a stone on the south bank of said lick branch, a sycamore pointer, thence up said branch S43°E 24 po. to the Beginning, Together with all and singular the appurtanances thereto belonging to have and to hold the same with the appurtanances to him the said Henry Yater, his heirs and assigns forever, and the said Moses and Jaley do further covenant that the said Jaley is seized of an indefeasable fee simple title to the said land, & empowered to sell the same, and further, for themselves, their heirs and Exors and the covenant the title of said land to said Henry Yater his heirs and assigns forever, against all claim or claims whatever to warrent and forever defend by these presents. I certify that the foregoing deed of conveyance from Jaley Hubbard to Henry Yater was produced in my office, on the 20th day of Sept 1834 and ackn'd by the said Jaley to be her act and deed for the purposes therein mentioned, and the same is truly admitted to record.
