Kentucky Land Deeds of the Descendants of Richard and Amy Williamson West And Extended Families (1834-1911) Transcribed by Benjamin Milton West of Union City, Tennessee March 20, 1999 Compiled from Documents Recovered by Charles David West of Fulton, Kentucky, Formerly of Mayfield, Kentucky Volume I Introduction The following deed transcriptions are among the greatest genealogical treasures. The original documents, preserved by this writer's grandfather, were amassed over a vast time span, ranging from 1834 to 1911. The majority of these documents originated in Kentucky, namely Graves and Logan Counties. However, one deed from Perry County, Tennessee, and another from Hickman County, Kentucky, are contained in this compilation. Individuals with Graves County connections can especially appreciate this work, for due to a courthouse fire in that county, a tremendous portion of the early deeds were destroyed. This researcher has applied his most dedicated and sincere efforts in transcribing them. Hopefully, this task was performed with an equal amount of accuracy. Due to old handwriting and an occasional tattered document, these deeds were of the utmost difficulty to read and to understand. The lack of education in the nineteenth century played a large role in obscuring the meaning of sentences within the original documents. As one may notice, each deed was copied word for word, some containing many errors of grammar and syntax. With an incentive to retain the precise meaning of the deeds, grammatical errors were not corrected. However, the within deeds from the late nineteenth and early twentieth century contain exemplary grammar. Nevertheless, it is this writer's deepest hope that copies of this compilation will be treasured by both researchers of the surnames within and genealogists of the said counties. Benjamin M. Laird, have this day bargained and sold and do hereby transfer and convey to Robert Humphreys and his heirs forever for the consideration of five hundred and eighty five dollars to are paid the receipt whereof is hereby acknowledged a tract of land in the state of Tennessee, Perry County, and District number six containing by estimation one hundred and forty eight acres and thirty poles be the same more or less and hundred as follows Beginning at a stake the NE corner of a 44 acre entry in the name of John T. Tully runs East 13 poles to a small Elm on the bank of Buffalo with a double white oak marked as pointers thence South 51 poles East up the river with its meander 14 poles South 41??degrees East 21 poles to a stake and blackberry thence South 25 ½ East 94 poles to a stake with two persimmons marked as pointers South 54? West up the bank of the river 14 poles to a stake thence West 164 poles to stake thence south 12 poles to a stake in the river at the lower end of the Island thence West 66 poles to a stake thence South passing the NE courses of a six acre entry in the name of H? Turner Commissioner in the Equity suit in the Graves Common Pleas Court of Amos West et al against John P. Humphreys et al of the first part and James H. West of the second part. Witnesseth that whereas W. A. Turner was ordered by a judgment of said Court under August 8, 1868 in the above named action to convey to the said James H. West for and on behalf of John P., R. D., S. F., W. H., R., N. E., and A. W. Humphreys who are ??? under 21 years of age all their interest as heirs at law of Robert Dec'd and Sophronia J. Humphreys in the West half of the North West quarter of Section 19 Township 4 Range 2 East in Graves County Now, therefore, by virtue of the premises the said W. A. Turner Commissioner as aforesaid doth hereby convey by "General Warranty" all the interest of the said John P., R. D., S. F., W. H., R., N. E., and A. W. West Dec'd. proceeded to divide according to order, and permitted the heirs to draw for the same, upon which proves J. W. West drew lot No. 5 and bounded as follows (Viz.) Beginning at a stake in east boundary line, the NE corner of lot No. 4, elm pointer bearing N 85 E 10 links. Black gum N 22 ½ W 23 links. Thence with said east line N 4 2/4 W 28 poles 14 1/4 links to a stake in said line. Beech, bearing ground stake S 73 E 16 links, Beech N 57 ½ W. 14 links, elm N 79 W. 14 links, being NE corner of lot No. 5. Now therefore this indenture witnesseth that the said Overbey, Shelton, and Wilkerson, commissioners as aforesaid for and in consideration of the premises, doth hereby grant, bargain, sell, convey, and confirm unto the said J. W. West, his heirs and assigns forever by general warranty the above described tract of land, together with the appurtenances thereunto belonging or in any wise appertaining. But said commissioners are not to be held individually responsible. Morris Commissioner of said Court, to expose for sale and public auction, to the highest and best bidder, the property hereinafter described; and WHEREAS, said property was sold in accordance with said order, on the 7th day of September 1891, for the sum of three hundred Dollars and zero cents, when J. W. West became the purchaser thereof; and WHEREAS, the report of said sale was confirmed by said Court at the January Term, 1892, and at the January Term, 1892, an order was entered directing M. L. Morris Commissioner to execute a Deed of Conveyance of said property to said J. W. West but for greater certainty, the record and proceedings in said case are referred to. Now therefore, this indenture, made and entered into this 28 day of January 1892 between Ernest Heflin, Ezra Adams, Bertha Adams, Ida Adams, Eliza Adams, Ella Campbell, and her husband James Campbell by M. L. Morris Commissioner of the said Court, of the first part and J. W. West of the second part, WITNESSETH,that for and in consideration of the premises, and for the further consideration of the full payment of the purchase price aforesaid, the receipt whereof is hereby acknowledged, the parties of the first part, by M. L. Morris Commissioner aforesaid has sold and by this writing doth convey to said party of the second part his heirs and assigns forever, the following described property, to-wit: Ninety two and one quarter (2 1/4) acres of land in the town of Clinton, Kentucky, Hickman County with the exception of one half acre (½) in North West corner as accepted in deed from Taylor and wife to Mary E. Byrd by deed of date July 16, 1884 and lying on the North and South banks of the branch reference is hereby made to said deed and also to the deed from S. E. Crisap to Sophia Taylor for a more particular description and known as the James and George Byrd lots and a lien is retained upon the above described land until the purchase money is paid, to have and to hold said property with its appurtenances, unto the said grantee, heirs and assigns. The said Commissioner conveys all the right, title and interest, legal and equitable of the said Ernest Heflin, Ezra Adams, Bertha Adams, Ida Adams, Eliza Adams, Ella Campbell, and her husband James Campbell in and to said property, and warrants the title thereto, so far as he is authorized by the judgment, orders and proceedings in said cause, and no further; but he does not bind himself personally by anything contained herein, in any event whatever. C. Gough by N. R. Crouch recd of sum November 23 1909 and of record in book #42 page 564 Graves County Clerks Office and by L. H. Cosby, to J. R. Curd and by said Curd to Crouch by recd of sum December 23 1902 and of record in Deed Book 30 page 188 in said Clerks office. Said Gough is to retain possession of said land until January 1st 1912 and (original document torn at this section) and sum said Gough agrees to pay lands for year 1911. Being the same land to which grantors herein derived title by deed from N. R. Crouch dated November 20, 1909 of record in Deed Book 42 page 564 in the Graves County Court Clerk's office.
