Winston, Admr of Thomas Stubbs decd, Dicey Stubbs the widow and James Stubbs, Thomas Stubbs, Lansey Stubbs, Edward Stubbs and Peter Stubbs, heirs of Thomas Stubbs, decd. by Geo Montague, A Commissioner specially appointedby the Green County Circuit Court of the (illegible) and Robert H. Gaines of GReen County and state of Kentucky, the other part. Witnesseth that whereas in a suit in chancery wherein Robert H. Gaines are complainants and the said Administrator, widow and heirs at law of said Thomas Stubbs decd are defendants at the NOvember term 1841 of Said Circuit Court, it was Ordered and Decreed that the defendants pay to the complainant in said suit the sum of $42.25 debt and 87 1/2 cents costs on or before the 1st day of the next succeeding term of said Court thereafter or 65 acres of land mentioned in the Complainant's bill be sold to pay said sum of money and whereas at the Nov term 1842 of said Circuit the said defendants having failed to pay Complainant's the sums of money, It is decreed and ordered that Wm B. Carlisle be appointed Commissioner to make sale of the land (illegible) and whereas it appears from the report of said Wm. B Carlisle report filed herein that he sold 65 acres of land and the appurtenances thereon mentioned as (illegible) to the highest bidder as requested by said decree on the 16th day of January 1843 and Robert H. Gaines became the purchaser, he being the highest bidder at the sum of $59.50, it being the debt interest and costs. Now, this indenture (illegible) that for and in consideration of $59.50 the said George Montague Commissioner as aforesaid that this day granted confirmed and conveyed and by these presents do grant confirm and convey unto the said Robert H. Gaines the said tract or parcel of land mentioned int he complainants bill and Commissioners report filed and bounded as follows. To wit begining at 3 bushes on the river Corner to lot number 9 in the division of David Smith's lands, thence to 156 poless to....Corner to ....division...thence 60 poles to two birches corner to lots no 5 and 7 in ...division thence N 61/2 E 156 poles to a Sycamore on the river thence up the river to the beginning... to have and to hold the said tract and parcel and appurtenances unto the said Robert H. Gaines his heirs and assignees forever and the said George Montague Commissioner as also doth covenant and agree to and with the said Robert H. Gaines that he will forever warrant and defend the said tract and parcel of land and appurtenances from the said Defendants and all and every other persons claiming the same to the said Robert H Gaines, his heirs and assignees forever. In Testimony whereof the said David G Winston, admr, Dicey Stubbs, the widow and James W Stubbs, Thomas Stubbs, Lansey Stubbs, Edward Stubbs and Peter Stubbs heirs at law of Thos Stubbs decd, have hereunto set their hands and seals to wit the 17th day of May 1843. Ordered to be certified to th Clerk of the Green County Court for Recording, which is done accordingly.
