for Hardin County at the Courthouse in Elizabeth Town on Monday the 10th day of May 1813 Present Adin COOMBS Nicholas MILLER and George HELM Esquires -------------- George McLEAN Esquire produced a commission from under the hand of his Excellency Isaac SHELBY Governor of Kentucky appointing him a Justice of the peace in and for the County of Hardin together with the following Certificate thereunder endorsed (towit) Hardin County Sct personally appeared before me William KEPINGER one of the Commonwealths Justices of the peace in and for the County the within named George McLEAN Esquire and took the Oath of fidelity and oath of office as a Justice of the peace in and for the said County of Hardin agreeable to the within commissions the 1st day of May 1813 Wm Kepinger JPHC Whereupon he took his seat --------------- Ordered that John FURGUSON take care of Polly DAVIS in such lodging and diet as her situation requires untill the Court of Claims should she remain in her present state of illness. ------------------------- Isom ENLOW produced in Court a commission from under the Hand of his excellency Isaac SHELBY Governor of Kentucky appointing him a Justice of the peace in and for Hardin County together with the following certificate thereon endorsed (to wit) Hardin County Sct This day personally appeared Isom ENLOW before me George HELM a Justice of the peace for the County aforesaid and took the oaths prescribed by law for Justices of the peace as well the oath prescribed by law to suppress dueling in this commonwealth given under my hand this 10th day of May 1813 Geo HELM Whereupon he took his seat -------------------------- Ordered that a summons issue directed to Grayson County against Thomas ATTURBURY and a summons to this county against Regin BLESSET Benjamin MEEKS and William WATKINS commanding them to appear here on the first day of our next July Term to shew cause if any they can why the administration of the estate of Richard ATTURBURY should not be taken from them. ------------------------- Present Samuel MARTIN Esquire and Isom ENLOW Esquire Absent George HELM Esquire ------------------------- On motion of George HELM a Justice of the peace in and for Hardin County he is authorized to solemnize the rites of matrimony whereupon the said George HELM entered into and acknowledged his bond with John MILLER his security in the penalty of five hundred Pounds conditioned as the law directs ---------------------------- On motion of George McLEAN a Justice of the peace of this county He is authorised to solemnize the rites of matrimony whereupon the said George McLEAN entered into and acknowledged his bond with Lewis WELLS and John MILLER his securities in the penalty of five hundred Dollars pounds conditioned as the law directs. ---------------------------- John ASHCRAFT came into court and acknowledged his bond as constable of Hardin County with Isom ENLOW his security in the penalty of one thousand Dollars conditioned as the law directs and took the several oaths required by law -------------------------- Present Joseph STITH Esquire ----------------- Aaron TERRY Esquire produced a commission from under the hand of his excellency Isaac SHELBY Governor of Kentucky appointing him a Justice of the peace in and for the County of Hardin together with the following certificate thereon endorsed towit Hardin County Sct This day came Aaron TERRY before me George HELM Justice of the peace for the County aforesaid and took the several oaths prescribed by law to suppress the practice of dueling in this Commonwealth given under my hand this 10th day of May 1813 Geo HELM Whereupon he took his seat ----------------------------- An Inventory of the appraisement of the estate of Jonathan HARNET deceased was produced in Court and ordered to be recorded -------------------------- Inventories of the appraisement and sale of the estate of George WISEHEART deceased was produced in Court and ordered to record ------------------------- John SHACKLEFORD appellant on an appeal from against magistrates Judgment Alexander WILLIAMSON appellee This cause being argued by the counsel on both sides and duly considered by the Court, It is the opinion of this Court that the magistrates Judgement be affirmed and that the appellee recover against the appellant the sum of seventy five cents his costs expended before the magistrate also his costs by him about his defence herein expended ---------------------------- Isaac VANMETER claims one days attendance for Deft Coonrod KARTER claims one days attendance for same --------------------------- The Court having taken into consideration the report made by the commissioners appointed to view an alteration proposed to be made on the road leading to the mouth of Wilsons Creek do establish the old road and quash the proceedings had and done on the new road and It is further ordered that all the hands that lives on John CRUTCHERs plantation do assist him in keeping the road in repair of which he is surveyor. ------------------------ Alexander WILLIAMSON vs on appeal from Philip JENKENS magistrates Judgment Ordered that this cause be continued untill the next Term of this Court -------------------------- John STEVENSON vs same John ECCLES Ordered that this cause be continued untill the next Term of this Court ------------------------------ Ordered that Ann REED be summoned to appear here on the first day of the next Term of this Court to shew cause why the execution of her husbands estate should not be taken from her ------------------------------ On motion of Thomas PRICE the administration of the estate of Richard PRICE deceased is granted him he having taken the oath required by law. Whereupon he entered into and acknowledged his bond in the penalty of five hundred Dollars conditioned as the law directs with John THOMAS and Samuel GOLDSMITH his securities --------------------- Alear WILLIAMSON P. JINKENS Tobias HENDRICKS & Philip BUZON claims one days attendance for plt each ----------------------------- Ordered that Isom ENLOWS John HODGIN William LARUE and David GREENAWALT or any three of them after being sworn before a magistrate of this County do ________ the personal estate and slaves if any of Richard PRICE deceased and that they make report to next Court ------------------------------ John HART came into Court and took the several oaths required by law as a constable in and for this county and entered into and acknowledged his bond in the penalty of one thousand Dollars conditioned as the law directs with Jasper TERRY and Aaron TERRY his securities. ------------------------------ William MORGAN came into Court and took the several oaths required by law as Constable of this County and entered into and acknowledged his bond with Hardin THOMAS and Charles HELM his securities in the penalty of one thousand Dollars conditioned as the law directs ---------------------------- John BAYNE came into Court and took the several oaths required by law as constable of this county and entered into and acknowledged his bond with Joseph KIRKPATRICK his security in the penalty of one thousand Dollars conditioned as the law directs ------------------------- William WITHERS Plt on motion to recover against amount of Alex POPEs claim Samuel PERCEFULL for which Judgment was rendered & Robert BLEAKLEY Deft against the plaintiff This day came the Plaintiff by his attorney and the notice herein being returned duly executed therefore on motion of the plaintiff It is ordered by the Court that the Plaintiff recover against the Defendants the sum of one hundred and fifty Dollars It being the amount of Alexander POPEs claim for which Judgment has been rendered against the plaintiff also the sum of three Dollars seventy eight cents the plaintiffs costs expended in the motion heretofore made by the said POPE against the said WITHERS also his costs by him about his motion herein expended and the said Defendants in Mercy ---------------------------- On motion of Robert HUNTER John YOUNG is given up to William D. STONE to learn the tanning business whereupon an Indenture of apprenticeship between Benjamin HELM on behalf of the said John YOUNG and William D. STONE was acknowledged and ordered to record and Robert HUNTER is released from the covenants by him made at the time the said John YOUNG was bound to him. ------------------------------- Ordered that James COX be and he is hereby appointed surveyor of the road from Dog Creek to the Hickory Cabbin in place of James HOUCHENS and that said HOUCHENS continue to work on the balance of the road to the river and that half the hands that assisted HOUCHENS do assist said COX in keeping his part of the road in repair. ------------------------ Ordered that all the hands living in the following bounds (towit) Beginning at mouth of salt river from thence down the ohio to the mouth of Abrahams Run thence up the said run the Breckenridge road and along said road to Kerp road with said road to keep ferry from thence down the river to the Beginning do assist James YOUNG in keeping the road in repair of which he is surveyor. ------------------------------- Ordered that Court be adjourned till Court in Course N.
